24-07-12 All the constituent Unions & Associations' representatives attended meeting with MTNL management on 23-07-12 in corporate office committee room. From management side, CMD, Dir (Tech), Dir (HR), Dir (Fin), ED (Delhi), GM (HR), Jt GM (HR), GM (A), Delhi were present. Issues of pension from Govt, revision of pension, stopping formation of pension trust, fitment with 78.2% IDA were discussed in length. United forum maintained its stand not to accept parity of pay scales with BSNL, because it is not workable, viable and legally sustainable condition to get pension from Govt. This issue will be deliberated with united forum in next two months to find a viable solution to prepare a road map before sending it to the DOT. Management assured that orders regarding revision of pension will be issued shortly. Regarding formation of pension trust, views of the UF will be conveyed to DOT and process will be stopped. Pay fixation with 78.2% IDA neutralization w.e.f 01-01-2007 was discussed in length, and management insisted to leave this issue in the name of poor financial condition and other reasons, but UF maintained that it is our legitimate right which is to be recognised and considered by management, we can not leave the issue. Ultimately management kept issue alive and assured to consider it in due course of time. Meeting lasted from 3 PM to 8.30 PM and after the appeal of the CMD, UF deferred protest action programme for two months . UF will review the situation after two months in the light of the development on various issues . Maintain unity and solidarity. Minutes are attached with previous news.

21-07-12 Executive committee meeting of United forum was held in CTO dormitory on 21-07-12 which was attended by office bearers of All unions and associations. United Forum representatives briefed the gathering and informed that no positive development has taken place, so work according to rule programme is to be observed in a effective way.

MASSIVE RALLY TO SANCHAR BHAWAN

A massive Rally was organised by United Forum from K.L. Bhawan to Sanchar Bhawan. More than 10000 Employees and Officers participated in the Rally, which was terminated at Parliament  Street. The gathering was addressed by the leaders of Different unions & associations. All the speakers stressed that there will be no compromise on the issue of Pension from Govt., revision of Pension and 78.2% fitment. The leaders announced that if the issues are not settled to the satisfaction of the UNITED FORUM, then Work According to Rule programme will be started very effectively from 24th July onward and also appealed to the employees/Officers to make the Work According to Rule Programme a grand success.

13-07-12 Meeting of united forum was held with MTNL managment on 12-07-12 in corporate office. 13-07-12 GS had a discussion with Dir (Fin) regarding exemption of income tax deduction on leave encashment at the time of retirement and requested her to take early decision on the matter on the line as  already has been discussed . She assured to take early decision.

·         Grand hunger fast at Jantar Mantar A large number of employees/officers sat on hunger fast and about 6000 serving and retired employees and officers participated in the dharna in support of fasting employees at Jantar Mantar on 12-07-12. The commitment and enthusiasm of employees was unparallel, inspite of heavy rain, all employees stayed at venue and a grand demonstration was held in lunch hour which was addressed by representatives of different unions and Associations. United forum representatives were called by management at 11.30 AM to discuss the demands. After the meeting, united forum representatives addressed the gathering and conveyed the decision to continue the protest action as the discussion with management was not to the satisfaction of the united forum.

10-07-2012 Meeting with GM (TY)--A meeting was held with GM (TY) to discuss the varoius issues related to the services of the area and issues related to the executives. Meeting was attended by Shri Sunil kumar DGS, Shri S.N.Rathi, CHQ representative, Shri J.P.Sharma, AS (TY), Shri Dharmendra Gautam, Area President, and all divisional secretaries of TY area. All issues discussed and resolved to the satisfaction of representatives. 
   
09-07-12 Last week, GS, DGS & OS met PGM(O) and had a discussion regarding shortage of  wi-Fi modems  & clip instruments, PGM(O) informed that there was no shortage of Wi-Fi modems  and told  that 4000 clip instruments were available at present and also assured that about 45000 clip instruments would be available by 15th July,12. All area secretaries are requested let the Association know about the factual position in their areas, so that matter can be further discussed with the managment.

03-07-12 Massive Dharna at JANTAR MANTAR---Under the banner of United Forum, more than 6000 employees and officers set on dharna at Jantar Mantar on 03-07-12 in support of their demands of payment of pension by Govt, revision of pension and fitment with 78.2% IDA. lunch hour demonstration was addressed by the General Secretaries of all the Unions and Associations. All the speakers stressed that protest actions will continue till our demands are met and further programmes will be observed more aggressively and ultimately there will be decisive struggle from 24th July,12 in the form of work according to rules, which may create lot of industrial unrest in MTNL. Com G.L.Jogi, President SNEA (I) and Com Prahlad Rai, GS, AIBSNLEA also addressed the gathering and assured their full support in this struggle for legitimate rights of the MTNL employees. 02-07-12 RLC (Regional Labour Commissioner) called a meeting of united forum representatives and MTNL management for reconciliation on the protest of MTNL employees and officers. Issues raised by UF were discussed in the meeting but, because issues related to pension and revision of pension were related to DOT/govt, so nothing could be discussed in respect of the solution of the issues, therefore, RLC has called DOT in the next meeting on 13-07-12Fitment with 78.2% was denied on the ground of non-affordability of the company.
   
02-07-12 MTNL management called United Forum representatives in response of protest notice  regarding pension from Govt, revision of pension & fitment with 78.2% IDA. Meeting was attended by united forum representatives and from management side, CMD, Dir (Tech), Dir (HR), Dir (Fin), ED, Delhi, GM (A) Delhi, Jt GM (HR) were present. 02-07-12 Issue of extension of last date of pro-rata pension option was discussed with CMD & Dir (HR) who told that last date was closed after the strong objection of DOT who said that how MTNL has exercised the power of extending last date for which it is not authorised, so any further extension will done only after taking consent from DOT for which MTNL will write to concerned authority in DOT along with the representation of Associations.

27-06-12  The Representatives of UNITED FORUM OF UNIONS & ASSOCIATIONS of MTNL met Sh. Oscar Fernandes Hon'ble MP & General Secretary (AICC) on 25 June, for seeking his support for resolution of pension issue of MTNL employees at par with BSNL and submitted a memorandum to him. Sh. 19-06-12 GS along with OS & DGS met Dir (FIN) and discussed the issue of income tax deduction on earned leave encashment at the time of retirement. GS requested her to take early decision on the representation of the Association for not deducting income tax on the leaves of the employees credited in their account on the date of absorption in MTNL, because those leaves were earned during central govt service and as per income tax rules ,there is no income tax on earned leave encashment in central govt services. BSNL has already taken decision in this respect. Dir (Fin) said that she will discuss again this issue with concerned officers and  let the Association know the exact position of the case in two/three days.

Meeting with Dir (HR)GS along with OS/DGS/treasurer and Shri J.J.Mathias, CS, Mumbai met Dir (HR) and discussed following issues.

1. Left out DPC for promotion from JTO to SDE---Association expressed the anguish of the affected officers over delay in conducting the left out DPC. Dir (HR) informed that CMD had asked certain information which have been provided and after his approval DPC will be conducted.

2. Below bench mark casesAssociation once again explained the issue and necessity to get it settled to its best ability. Let us hope we will get justice.

3. 120 days HPL (Half Pay Leave) limitAs per MTNL rules, there is a limit of 120 days HPL which badly affects some employees who require more medical leave. Now a HR proposal has been prepared to remove this limit. This proposal is expected to be put up in next board meeting for its approval.

4. Last date of pro-rata pension optionAssociation strongly opposed the decision of management not to extend the last date of pro-rata pension option beyond 30th June 2012 given the fact that pension issue is still unsettled while the reason to extend last date again and again was the unsettlement of pension issue. Dir (HR) said that decision of not extending the last date of option was taken after the objection of DOT on this extension without any specific order on the subject. After detailed discussion, he said that representation of Associations to extend the date will be taken up in the board meeting for its consideration.

5. Withdrawal of pro-rata pension option--There are some officers of Mumbai unit who want to withdraw already exercised option of pro-rata pension which have been turned down by corporate office on the ground that options have been processed and sent to CCA. On our request, Dir (HR) asked Association to represent the cases again and assured efforts will be made to recall the cases if procedurally possible.

General discussion on the financial viability of company also took place. Dir (HR) wanted certain information on some of the proposals/suggestions of Association to increase the revenue through unconventional means.

 
   
16-06-12 GS along with OS Shri R.K.Mudgal, CS Mumbai Shri J.J.Mathias, ACS Mumbai Shri Virender Singh met Jt GM (HR) to follow up the pending HR issues. Seniority cases, pro-rata cases and DPC issues were followed up. He informed that JTO(C) to SDE (C) DPC of 8 officers has been conducted and orders will be issued shortly. Screening report for DPC from SDE (C) to XEN (C) has been called for from Delhi & Mumbai unit.

Meeting with CMD—GS along with Com Sunil Kumar, DGS, Com J.J. Mathias, Circle Secretary, Mumbai, Com Virender Singh, ACS, Mumbai met CMD on 13-06-12 and discussed following issues.

1.     Left out SCF DPC from JTO(T) to SDE (T)—GS apprised him of the whole issue and requested  to get the left out SCF DPC at the earliest and after that LICE to contain the demoralisation & frustration amongst the officers who are eagerly waiting their long awaited legitimate due right of promotion. CMD said that he is aware of the issue and it has been discussed with Dir (HR). He asked Association to discuss with Dir (HR) again for early DPC.

2.     Below bench mark cases— GS briefed about the issue and pleaded for considering old CRs with old bench marks for financial as well as functional up gradations and also to review the new bench marks in view of the proposed bench marks of BSNL which were proposed by him only as Dir (HR) BSNL. He appeared positive but asked to discuss again with Dir (HR).

3.     Issue related to time bound functional promotions as assured in terms and conditions of absorption was discussed and he said will again be discussed in the days to come.

4.     Issues related to services and shortages of material were also discussed. He informed that Ist lot of delivery of wi-fi modem has been received and distributed in Delhi and Mumbai. Issues related to marketing and sales were also discussed. Association proposed to come again with a detailed presentation on sales and marketing in days to come. CMD asked Association to come any time with the suggestions and proposals related to sales, marketing and services and assured to take appropriate actions to implement good suggestions.  He also said that if we could increase our revenue by 15 to 20%, we can be able to get support from govt to turn around the company. He asked Association to make its efforts to increase the revenue through its members.

5.     A brief discussion on pension and 78.2% fitment was also done in which Association made it clear that we will fight strongly through United Forum for pension from Govt and 100% IDA neutralisation with 78.2% IDA fitment and other issues.

12-06-12 Divisional representative body of Rajpath Sena Bhawan Division--A general body meeting of Rajpath & Sena Bhawan Division was held on 08-06-12 in which new representative body was elected in the presence of Area Secretary (central) Shri K.S.Attree and Area President Shri Sanjay Sharma, Shri V.K.Jain, Shri U.C.Jain & Shri A.K.Sharma were elected as president, Divisional Secretary & Treasurer respectively. 
   
 11-06-12  United Forum Meeting--In view of persuation of DOT to form a pension trust for MTNL employees/officers and presentation of MTNL managment before Hon'ble MOC & IT on 08-06-12 regarding pension trust instead of persuing for pension from govt as in BSNL, meeting of united forum of MTNL unions and Associations was held on 11-06-12 in which it was decided to oppose the formation of pension trust and fight for pension from Govt as in BSNL. Organisational action notice will be served shortly. Members are appealed to be ready for struggle.

GS along with other CHQ office bearers and Area President Shri A.P.Singh & Area Secretary Shri Shailender Chauhan attended the meeting and briefed the house about the various issues related to the executives and appealed the members to do their best to increase the revenue by 15 to 20 %  and assured the house that Association  will not leave any stone unturned to see the settlement of pending issues.

02-06-12 Left out DPC for promotion from JTO to SDE--In the meeting with Dir (HR) on 28-05-12, GS had expressed the resentment of Association and members for not holding the DPC for all vacancies of SCF and pleaded for holding the left out DPC in this week only. After brief discussion, Dir (HR) said efforts will be made to conduct the DPC for left out vacancies in next week.

LICE-In the last meeting with Dir (HR) and GM (HR), the point to conduct the LICE with objective paper only was discussed in length, but Dir (HR) & GM (HR) did not agree the suggestion of abolishing the subjective paper.  The issue of objective paper will be further discussed with the management. 

02-06-12 GB meeting of MPLC Division--GB meeting of MPLS division was held today at lunch hour in room no 555 Kidwai Bhawan. GS, DGS, Shri Sunil Kr, Sr Vice President Shri Parmil Gupta, OS, Shri R.K.Mudgil, Chq Treasurer Shri Satyavir Singh, Area President (BB) Shri A.P.Singh, Area Secretary (BB) Shri Shalaindra Chauhan attended the meeting.  Members raised many queries which were replied by GS. GS asked the members not to be impatient and misguided by base less rumours and assured that all pending issues will be settled to the satisfaction of the members. New Divisional Body was formed. 01-6-12- GB meeting of SHD division---GB meeting of SHD division was held today at closing hour. Meeting started at 5 PM and ended at 8PM. Members raised many queries related to left out DPC, ITS repatriation, pension, service problems, MTNL financial condition etc. GS addressed  the house and clarified the queries and assured to get the E3 SCF DPC at the earliest. Election of Divisional body was also held. Shri D.P.Singh, Shri Laxman Singh & Shri K.S.K.Upadhyay were elected as president, Div Secretary & Treasurer respectively. 23-05-12 Meeting with PGM (O)--GS & DGS met PGM (O) and discussed following points.

Shortage of  Wi-Fi modems and Clip instruments in the areas-- He said that BB connections are being provided with the recovered modems and informed that 35 thousand  new Wi-Fi modems will be available by Ist week of June and tender for purchase of one lakh twenty five thousand Wi-Fi modems is in process which will be finalised shortly. Regarding clip instruments, he informed that twenty thousand instrument are available in CSD and for further purchase process is on. Issue of lifting Jointing kits from CSD was also discussed. Association raised the problem of field officers in lifting the jointing kits from CSD because they have to carry the vehicle to lift even one or two kits frequently which is wastage of time and money . PGO said that it is to be managed by area to lift the store items from CSD as per their requirement and sanction. He asked Association to discuss with Area GMs and also assured to talk to concerned GMs.

Officiating promotion orders in DE cadre--Association expressed its concern over delay in issueing officiating promotion orders in the cadre of DE even after the assurance by ED. PGM(O) informed that posting of officers after promotion is to be decided which will be most probably finalised in two/three days after which orders will be issued.

Members raised many issues related to shortage of store items and welfare of executives. GS briefed the house about the various issues related to financial condition of the company and welfare of the executives. Hon High Court of Delhi out rightly dismissed the modification application filed by BSNL/MTNL seeking 25 months time for repatriation of unabsorbed ITS officers working in BSNL.

Even desperate plea made by the BSNL/MTNL counsel to give time upto 31stDecember, 2012 was rejected by the Hon Court. Hon HC while dismissing the application of BSNL/MTNL directed it to complete repatriation process by 30th Sept, 2012. Intervention applications of Associations/unions also dismissed on the ground that they were not party in original application.

Meeting with Dir (HR)—GS along with DGS, Com Sunil Kumar & AGS, Com Sanjay Kumar met Dir (HR) on 14-05-12 and discussed following issues.

1.   DPC from JTO (T) to SDE (T)Association pleaded for DPC against all vacancies of SDE of seniority cum fitness quota in on go at the earliest. Dir (HR) said that DPC is in process and he will look into the feedback given by Association regarding filling all available SCF vacancies in one go.

2.   Review of below bench mark casesAssociation expressed its serious concern over non action of management on this issue in spite of many assurances, and requested to consider the cases. Dir (HR) again assured to look into this matter.

3.   Anomaly committeeHe assured to expedite the process to form this committee at the earliest so that pending cases can be decided in corporate office.

4.   Review of promotion policy in view of PSU hierarchy- Association pleaded for review of promotion policy in view of PSU hierarchy and asked him to take necessary actions to start the process of taking opinion off different sections so that a fair and attractive promotion policy can be decided.

5.   ITS absorption/repatriation issue-Association expressed the serious concern about the uncertainty of ITS issue which is adversely affecting the working of the company and pleaded for early action on the decisions on this matter in the interest of the company. Association also made it clear that if management fails to end this uncertainty, Association will be forced to take all available means to end this uncertainty in the interest of the company.

Seniority cases in the JTO/SDE cadre--Association discussed all the seniority cases pending in JTO/SDE cadre and  pleaded for taking early decision on the basis of court judgements.

Meeting with GM (HR)GS along with DGS, OS & Treasurer met GM (HR) on 10-05-12 and discussed pending issues. Jt GM (HR), DGM (Pers) & Sr Manager (HR) were also present in the meeting. Following issues were discussed.

DPC for promotion from JTO (T) to SDE (T) GM (HR) informed that DPC process has started today and Ist phase completed. Association made it clear that DPC is to be conducted against total vacancies of seniority cum fitness quota before LICE and any move to conduct DPC in parts will be strongly opposed by Association. GM (HR) told that she would look into the inputs provided by Association in this respect.

Pay anomaly casesAssociation raised many issues of pay anomaly where juniors are drawing more pay than seniors and also the case of grant of all consequential benefits and fixation of pay on notional bases w.e.f 23-01-2002 in respect of LDCE candidates who cleared competition for SDE in 2002. GM (HR) told that keeping in view the pending cases in corporate office; it has been decided to form an anomaly committee at corporate office level for which file has been put for approval. All these cases will be given to that committee. GM (HR) said that it will be better for Association to explain all these anomaly cases to the said committee after its formation.

Benefit of one increment on promotion in the same scale—Case of denial of one increment on promotion to DE/CAO to those officers who are in same scale was discussed and Association argued that there is a provision of one increment on promotion in same scale as per Gr B level promotion policy, so this benefit should be given at the time of promotion from SDE/AO to DE/CAO. GM (HR) told that this issue is still to be deliberated in corporate office and said that decision in this respect will be taken in the days to come shortly.

JTO (civil) ACP case-GS informed GM (HR)/Jt GM (HR) that clarification sought by corporate office from Delhi unit has been received in corporate office. Jt GM (HR) assured to expedite the case.

RR for promotion from AM (HR/Mktg/legal/CS to DMAssociation expressed its unhappiness over reluctant attitude of management towards promotion prospects of these officers. Association informed that a good number of talented officers of this category have already left company because of poor carrier growth in MTNL. Association asked GM (HR) to finalise the RRs at the earliest so that these officers who are stagnating in the same cadre for last so many years can get their long awaited first promotion. GM (HR) told that it is in her agenda and will pursue for early decision.

Many other issues related to the seniority of executives in different cadres were discussed. Association asked GM (HR)/Jt GM (HR) to expedite the cases for their settlement.

GS told GM (HR) that the promotion policy of MTNL executives’ is to be reviewed and present RRs need to be amended for faster and smooth promotion of executives to motivate them to meet the challenges before the company. GS informed her that Association will come out with certain proposals for amendments in RRs.

Association has cleared three welfare claim cases @ Rs 25000/- Per claim, but the contribution received in this head is less than what we have paid to the families of our departed Comrades in last few months. Association is fighting two cases in the court of law. Association has also to pay the membership to NCOA, but no special contribution has been taken from members in the name of court cases etc. All above expenditures in addition to the other recurring expenditures of the Association are met with the membership contribution.  Therefore, all members are requested to pay their membership contribution to their concerned office bearers. And all Area/Div secretaries are requested to collect the up to date subscription and remitte the CHQ quota at the earliest with CHQ Treasurer along with the list of membership.  

 

   
 

Meeting with ED Delhi---GS along with OS, DGS & Treasurer met ED and discussed following issues.

1.      Financial upgradations in different grades of executives—informed that he has cleared most of the files he received except two files which he cleared during the meeting  and asked Association to follow up other pending financial upgradation cases if any, all will be cleared in a day or two.

2.  Functional promotions in different cadres of Executives--   ED assured that after getting  clarification from corporate office, pending promotion orders from DE to DGM, SDE to DE and JTO to SDE will be issued in 7 days. He spoke to Dir (HR) who assured that clarification will be issued shortly. GM (A) spoke to GM (HR) who said that clarification will be issued in 2/3 days.

3.  Issues related to sales and services were discussed in length. Many suggestions given by Association to improve marketing and increase the sales were appreciated by ED who assured to take certain steps to improve the sales and marketing and divulged many steps taken by managementk to improve the land line/BB services.

Grand open session of MEA, Mumbai circle

On the occasion of circle conference of Mumbai circle, a well organised grand open session was held on 12-04-2012 in Mumbai. Huge number of officers attended the open session.  CMD, MTNL, Shri A.K.Garg was the chief guest of the function, ED (Mumbai), Shr. Peeyush Agarwal, CGM (WS) Shri Chheda, GM (A) Shri.P.K.Adhikari,  Shri A.K.Thakkar GM (Inst),  Shri S.K. Arora GM (sales), Shri S.D.Chavan CGM (Personal) HOCL, Com W.S.Rao ex-GS TEOA(I), Com A.R.Adsul CS (MH) SNEA , Com Ashok Rao, National President, NCOA and other office bearers of NCOA (west Zone) graced the occasion. Open session was presided over by Mrs Ameya Pathare, President,MEA, Mumbai unit. Com S.N.Prasad CHQ President, in his key note address, raised the following points 1. Pension at par with BSNL, VRS,  shortage of wi-fi modems, installation of FTTH,signalling problem of GSM, DPC in all executive cadres, no lateral entry at any level etc. Com. V.K.Tomar, GS in his address raised the vital policy issues which are responsible for making the cash rich company with RS.5000/- crore surplus few years back to a sick company with Rs.10500/- crore loan on its balance sheet. He attributed the wrong govt policies like Rs.11000/- crore spectrum charges, non-settlement of pension issue for today’s situation of the company, and asked the CMD to take strong and early actions for refund of un utilised BWA spectrum cost of rupees 4534/- crore by surrendering it to govt, and also strong pursuance for pension settlement from govt through DOT.GS stressed on fast decisions by management for turning around the company and also to create a strategic group comprising management and Association representatives to work out the turnaround plan so that MTNL can be turn around by the end of year 2013 as has been visualised by CMD himself .GS said in the house that any move of management to make any cut in the due benefits of the employees will be strongly opposed by this Association, he also raised the HR issues like, time bound promotions by personal up gradation of post upto Jt GM and no lateral entry above E2 level.  ED Mumbai Shri Peeyush Agarwal, during his address was surprised after seeing such a huge gathering in the open session and appreciated the strength and sincere efforts of Association leadership and members for improvement of the performance of the company and gave the account of developmental activities in Mumbai circle and also appealed the officers to further improve the efficiency of the services.

CMD’s ADDRESS---CMD in his address thanked the Association for giving him this opportunity to address and interact with such a huge gathering of officers for the first time in MTNL. He touched all the vital issues related to the survival of the company. He said BWA spectrum will be precious asset in the years to come, but today’s priority is to survive so MTNL board has approved the surrender of BWA spectrum to get back rupees 4534/- crore which may give life to MTNL for another five years. He said Letter has been sent to DOT to surrender BWA spectrum, now DOT has to decide. Regarding pension issue said that he has made many presentations before Secy, DOT and parliamentary committee, but nothing concrete has come out. He informed the house that at present there are three options available for settlement of pension issue 1. Continue with existing practice, 2. Accept pension on BSNL scales and continue with existing MTNL pay scales till next pay commission and accept equal pay scales with BSNL in next pay commission, in this option mode of payment of pension will be at par with BSNL, 3. Formation of trust for which govt has to pay Rs 2600 crore for pension fund, he stressed that this option will be more viable if govt pays Rs 2600/- crore for pension fund. VRS-he said that MTNL will bring VRS only if govt pays for it, MTNL will not go for loan from mkt for VRS.

CMD stressed on sale and after sale services, he said that if every employee brings two connections, it may add more than 80,000 new connections to MTNL which will increase substantial revenue which is very much required for the survival of the company. He appealed the house to concentrate on sales and after sales services. He appreciated Mumbai unit efforts in this direction where more than 15000 new connections have been added through this scheme by observing customer connect month, but asked Com V.K.Tomar, GS to make more efforts in Delhi which is lagging behind in bringing new connections through this scheme. He assured that the issues raised by Association regarding poor coverage and shortage of essential items will be addressed.

GS had a discussion with GM (HR) regarding pending issues and met Jt GM (HR) and DGM (P) along with DGS & OS on 07-04-12 to follow up the on-going issues.

1.     JTO to SDE SCF DPC—he informed that DPC process has been started and is likely to be completed by 2nd or 3rd week of April.

2.     JTO (Civil) ACP case—he informed that orders will be issued shortly

3.     Seniority cases of some SDEs of Mumbai circle—orders have been issued and order copy was provided to Association

4.     JTO to SDE LICE—Competitive exam which was scheduled to be held on 15th April has been postponed because of MCD election in Delhi on that date. New date will be decided later on.

5.     Anomaly cases—DGM (P) informed that an anomaly committee is being formed at corporate office to decide the cases forwarded by Delhi/Mumbai units.

6.     DE to DGM adhoc promotion-screening report of both the units have been received in corporate office, but DPC date has not yet been decided. Dir (HR) will decide on the issue.

GS had a discussion with ED (Delhi) on time bound and functional promotions in different executives’ cadres and grades, He said financial upgradation orders are being issued after the clarification from corporate office and for functional promotion, a clarification has been sought from corporate office regarding seniority of SDE cadre. He asked GS to meet GM (A) to know the latest status on these issues. GS met GM (A) on 07-04-12, who informed that financial upgradation cases are in process and orders in different grades will be issued shortly. And regarding functional promotions, a letter of clarification regarding SDE seniority will be sent on Monday to Dir (HR). And after receiving clarification from corporate office, functional promotion orders in different cadres of executives in telecom wing will be issued.

CEC meeting- CEC meeting of Delhi was held on 24-03-12  in which GS briefed the house about the status of current issues viz, JTO to SDE DPC, LICE, Sr Manager competitive exam, status of court case of Sr Manager RRs and the stand of the Association on these issues. GS also briefed about the financial condition of the company and its consequences on the legitimate rights of executives, and also stressed on exploring the ways to turn around the company because who so ever may be the responsible for today’s condition of the company but ultimately its poor financial condition is badly affecting the interests of its employees, so we will have to understand and accept the ground realities and will have to take the leading role in bring out the company from this situation. Blame game cannot help to improve the condition of the company and protect the interest of employees. Com G.L.Jogi General Secretary, SNEA(I) addressed the CEC and stressed on the performance of executives, and also underlined the need of fast promotions of the performers.

 CEC passed following resolutions.

1.     1. Formation of a committee to study and recommend the promotional aspects of executives in PSU hierarchy to ensure fast and smooth promotions in MTNL—GS explained that present promotions in MTNL are given as per existing Recruitment Rules of MTNL, but these RRs are not in the lines of PSU hierarchy promotion rules and do not provide attractive and smooth promotion prospects to the executives. Therefore, Association has to propose ways to ensure fast and smooth promotions as per PSU hierarchy, for which a committee of some executives is to be formed to study and suggest promotion prospects in MTNL. This proposal was unanimously passed by CEC.

 2. Association’s Technical CommitteeToday, company is posting the loss in the tune of Rs 2500/ crores PA which is increasing in every quarter. But still there is no concrete turnaround plan with the management. Not only this, but it appears that losses are not kept in mind when new projects/services are decided and new projects are given priority over the maintenance of existing services which ultimately results in rise in losses. GS proposed a Association’s Technical Committee of expert members of different disciplines and segments of MTNL who can suggest the turnaround plan and its views on new projects/expansion and maintenance of existing services to improve the revenue of the company. CEC unanimously passed the proposal.

2.     GS appealed the office bearers to arrange the sales counters for a day in the localities where they are residing. Association will ask the Management to provide all essential materials and concerned staff for promoting our products and increasing sale through these counters.

1.     SCF DPC from JTO(T) to SDE(T)---Association pleaded for SCF DPC before LICE. Dir (HR) assured to conduct the SCF DPC before LICE.

2.     Review of below bench marks cases already communicated to himDir (HR) said that he will consider the cases communicated by Association to him.

3.     One increment on regular promotion in the same scale—GS asked Dir (HR) that the cases of regular promotion in the DE/CAO cadres have already been discussed and written by this association two times but nothing has been done so far. Dir (HR) said that these cases will be reviewed in broader prospective including all cadres.

4.     Prorata-pension option date extensionAssociation asked to extend the prorate pension option date which is going to be expired on 31st March 12. He said process will be started to extend the date.

General body meeting of BCP & Chankyapuri Divisions- GB meeting of BCP & Chanakyapuri Div was held in BCP committee room on 16-03-12. A large no of officers attended the meeting. Meeting was presided over by Sh Anil Mahajan, DE (OD). Meeting was addressed by Sh B.S.Dalal, CHQ,President, Sh V.K.Tomar,GS, Sh Sunil Kumar,DGS, Sh J.S.Yadav, Area Secy. Sh Gulshan Khurana,DS, BCP, Sh Dinesh yadav, DS CHy and Sh Akela, DS HK were also present. GS appraised the house about the financial condition of MTNL and the challenges before the Association in the days to come to protect the legitimate right of the employees and to fight against the wrong policies of Govt. He also   explained the issues like, pension, promotions in different executive cadres, VRS & ITS absorption etc and also clarified the queries of the members. GS emphasised on the strong single executive Association for the survival of company and its executives in this changing scenario. GS appealed the members to be united and not to be misguided by any negative and destructive forces.

 General body meeting of HQ division—A GB meeting of HQ-I division was held in K.L.Bhawan on 16-03-12. A large no of officers of HQ attended the meeting. Status of SCF DPC from JTO to SDE---Screening report of Delhi unit has already been sent to Corporate Office. Screening report of Mumbai could not be sent to corporate office because there was a stay on Mumbai gradation list, but yesterday Hon’ble CAT Mumbai has pronounced the judgement which was kept reserved for quite some time. Now Mumbai screening report will also be sent to corporate office most probably by next week. GS along with DGS & OS met Jt GM (HR) CO and asked him to expedite the DPC process so that it can be completed before LICE which is scheduled to be held on 15th April. He assured that SCF DPC will be conducted before LICE and all efforts will be made to complete the DPC by 31 March 2012.

 

   
15.03.12 Meeting with GM (A)—GS along with DGS, OS & Treasurer met GM (A) and asked him to issue the financial up gradation orders in different grades of executives for which DPCs have been done.  GM (A) assured that financial up gradation orders of all grades will be issued shortly except E6 to E7 regarding which ED requires some more information. Regarding functional promotion in different cadres on officiating/LA basis, GM (A) informed that ED is still to decide the number of posts of GMs and DGMs in Delhi unit in consultation with corporate office and further the number of DGM (sales) posts in place of GM (sales) and then promotions in different executive cadres will be decided. Today, our case of challenging the Sr. Manager RR came up for hearing in the Principal Bench CAT. Hon’ble CAT clubbed the case of TEAM with our case.

MTNL has not filed the reply in the CAT , w.r.t the cases.

During today's discussion in the CAT, the Advocate of TEAM argued only to fill up the DE/Sr. Manager posts lying vacant.

Our Advocate additionally also challenged lateral entry at E5 and requested for quashing of Sr. Manager Recruitment Rules.

Finally after brief discussion with the Advocates of MTNL EA/TEAM/MTNL, the Hon’ble CAT asked the MTNL NOT TO DECLARE THE RESULT OF THE E5 COMPETITIVE EXAM TILL the NEXT HEARING DATE, i.e. 19th April 2012 and ASKED MTNL to FILE its REPLY.

Meeting with CMDGS along with DGS met CMD on 27-02-12 and had an intensive discussion on how to increase the revenue and come out of this threatening situation. Focus remained on mobile services, leased lines and BWA spectrum.

We raised the issue of poor coverage of mobile network and non-availability of GSM Data Card. CMD informed that tender for equipment for expansion of mobile network has been finalised and hopefully in next 6 to 8 months mobile network will be expanded and there will be no coverage problem, he also informed that 3000 GSM Data cards have been made available and during meeting asked ED(WS) to send further requirement so that arrangement of more data cards can be made. But he told that there is a huge shortage of mobile product selling network for which there is a terrible need to increase the DSA (Direct Selling agents), franchises, and retailers. He also said there is also need to increase the franchise managers and retailer managers for proper functioning of the franchises and retailers. He said that there should be MTNL product selling outlet at each and every locality. He said that MTNL retired employees and serving employees family members can also become the DSA (Direct Selling Agent), and for them there will be no deposit and limit of per month sell can also be reduced.

Meeting with ED, DelhiGS along with OS & DGS met ED on 17-02-12 and discussed following issues.

1. JTO to SDE screening for DPC to regular promotions-Association brought to his knowledge that corporate office has to conduct the DPC for regular promotion from JTO to SDE against SCF quota for which screening report and vigilance clearance has been asked from Delhi and Mumbai unit. He was also informed that screening has been completed and report is lying with him for his approval for quite some time, and pleaded with him to send it to corporate office at the earliest so that DPC can be conducted. He assured to do so.

2. JTO to SDE officiating and looking after promotions-Association reminded him that after our discussion with him, the CRs of 35 JTOs were called for looking after promotions which have been received long back in CR cell, but inspite of many assurances, promotion list has not been issued so far. Association also pleaded with him that there is acute shortage of SDEs in many areas because officers are retiring and no substitute is being provided for a long time, and also JTOs are stagnating in the cadre for more than 15 years. As usual, ED was reluctant on promoting the officers on one pretext or other like downsizing the officer cadres right from GM to SDE, and shortage of JTOs etc. After intensive discussion he agreed to work out on the promotion list.

3. SDE to DE LA/offtg promotions—He took the shelter of P&H high court decision regarding seniority of TES GR B (SDE) and said that clarification has been sought from corporate office in this regard and local promotions in these cadres will be given after getting reply from corporate office.

4. DE to DGM looking after promotions—ED maintained the position that clarification from corporate office is required in respect of P&H high court decision on seniority issue. Although Association tried to convince him that the officers on the top of seniority for LA promotion to DGM in Delhi are not going to lose their seniority by implementation of court decision because in either way they will be senior. But ED did not agree and asked GS to get reply of clarification from corporate office.

5. Financial upgradations E3-E4/E4-E5/E5-E6—Association informed ED that Association has learnt that DPC reports which were sent to him for his approval have been sent by him to GM (law) for seeking legal opinion on the implication of P&H high court decision on these financial upgradations. Association clarified him that court decision has nothing to do with these financial upgradations and asked him to clear the DPCs. He noted all cases and assured early actions at his level.

 

General issues including delay in tender process for various items were also discussed.

MTNL Q3 net loss widens to Rs 930 cr

State-tun telecom company MTNL today widened its net loss to Rs 929.77 crore for the quarter ended December 31, 2011.
In the corresponding period last year, the loss was Rs 671.04 crore in the, MTNL said in a filing to the BSE.
The total income also dipped about eight% to Rs 874.76 crore in the reported quarter from Rs 951.22 crore in the October-December quarter of 2011.

During the quarter, MTNL's revenues from basic services stood at Rs 678.27 crore, while that from cellular services was Rs 180.94 crore.

MTNL has over nine million mobile and wireline subscribers and offers services in two circles— Delhi and Mumbai.

NCOA Resolution regarding the strike call given by Trade Unions on 28/02/2012. The NGC held at Bangalore resolved as under. That the officers of CPSU under the fold of NCOA express support to the General strike call by the trade unions to be held on 28 th Feb 2012. The officers shall work as per rules and shall not undertake any work that is normally undertaken by workers. The officers shall not stay overnight in the factory/office premises. The officers shall not cross picket lines set up by workers. It shall be the exclusive responsibility of the management to provide security and protection to the personnel and assets of the undertaking. In process industries managements are requested to take shut down rather than endanger the plants. Officers shall not be responsible for the safety of the plant if the plants are run. This is being communicated to all the Zonal secretaries and General secretaries of officer associations who in turn shall write to the chef executives of respective PSE.

PGM(O) informed that in view of P&H high court decision regarding TES Gr B seniority, decision in respect of promotion for DE/DGM could not be taken and issue will be discussed further. But assured that JTO to SDE officiating/LA promotion case will be expedited. He also asked GM (A) to start the process.  
06.02.12 Meeting with DDG(Estt), D0T-- SG and OS met DDG (Estt) and Dir (Estt) DoT and briefed them that CCA Mumbai has not settled the pro-rata pension cases, and has questioned the authority of MTNL to extend the pro-rata pension option date. CCA has sought clarification in this regard from DoT. SG emphasized that pro-rata pension option date is to be kept open till the pension case of MTNL, which is pending with govt, reaches to logical conclusion. SG also requested him to ask CCA Mumbai to settle the cases of employees who opted for pro-rata pension.  DDG assured for positive action.
04.02.12 Meeting with Dir (Tech)-SG along with OS, DGS ,& treasurer met Dir (Tech) and discussed various issues ranging from  surrender of BWA spectrum to FTTH and other revenue earning projects. Dir (Tech) gave actual status account of all projects.

Brief history of Sr Manager Recruitment rules and stand of the AssociationAfter the completion of absorption process in 2004,  a draft promotion policy   was brought out by MTNL management in 2005, in which time bound promotions were upto E4 only, and above E4 all promotions were on selection basis with stringent attendant conditions with weightage of qualification , marks of CRs and interview.

Against this draft promotion policy of MTNL management, Joint forum of Executives’ Associations of MTNL (MEA + TEAM) served trade union notice demanding time bound promotions upto E7 without stringent attendant conditions as assured in terms and conditions of absorption. There was also a parallel agitation of executives Associations in BSNL with same demand. Hon’ble MOC&IT intervened in BSNL agitation and asked DOT to look into the matter. MTNL management took stand that promotion policy cannot be decided in isolation in MTNL, and it has to be same in both the companies ie MTNL & BSNL. MTNL management asked us to pursue the case in DOT along with BSNL Associations. Later on, we pursued the issue in DOT along with BSNL Association and management and had numerous meetings with Secretary and Addl Secretary DOT. After one and half year persuation, time bound financial upgradation upto E7 was approved by DOT with old bench marks which were applicable in functional promotions in DOT. But, for post based promotions, DOT and BSNL/ MTNL management were adamant to fill 50% posts of STS (DE) by external candidates through competitive exam (in DOT, it was through ITS) , while Associations wanted all STS level posts to be filled up through internal officers only .  Finally, Secretary, DOT took a decision of 50:25:25 i.e 50% through seniority cum fitness and 25% through competitive exam from internal candidates and 25% through competitive exam from external candidates. In spite of the opposition of external recruitment by Associations, BSNL management notified MT recruitment rules, which were followed by MTNL and notified Sr Manager Trainee recruitment rules. Joint Forum of Executives’ Associations of MTNL (MEA+TEAM) opposed this 25% external recruitment, upper age limit and qualification of internal candidates, and wrote a letter to Dir (HR)  on dated 13-3-2009 opposing 25% external recruitment and demanding 50% competitive quota through internal candidates only by LDCE. <<<Click for Joint forum letter>>>>. Since then, MEA has been pursuing to get away external recruitment quota and to remove upper age limit & qualification of internal candidates. Many meetings of MEA & JF were held with management in this regard. Management changed the eligible qualification of internal candidates from BTech/CA to BSc/Bcom, but did not agree to stop external recruitment, and notified the Sr Manager Trainee exam for 30 posts of Telecom and 10 post of marketing open to both internal and external candidates with 50% posts reserved to internal candidates. Even after this exam notification, MEA kept opposing external recruitment and demanding age relaxation for internal candidates. Upper age limit for internal candidates was increased from 40 to 55/50/50, but management did not agree to get away external recruitment even after our persistent efforts. Now we are left with no option but to take legal opinion on this issue and take the matter to court of law to get honour of the assurance given by management to the Association through minutes of meeting in which they assured that recruitment will be at entry level only.

From the very beginning, Association has been demanding and pursuing for promotions on time bound basis with upgradation of posts upto E7 as assured in terms and conditions. Other than MEA, no one supported and demanded PSU hierarchy which was assured by management itself. Association is fighting for last many years, and will continue to fight for this in the days to come. In last meeting, present CMD did not agree our proposal of time bound promotions with personal upgradation of post. So get ready for any type of struggle to achieve our goal of faster promotions in PSU hierarchy on time bound basis.

Members are requested not to be misguided and carried away by any rumour. In case of any doubt, get clarification from CHQ office bearers. Association is strong enough to do anything to bring justice to the members. Maintain unity and confidence in the Association.

Shri Ashok Rao and Shri Baby Thomus were elected as President and Secretary General. Shri V.K.Tomar, SG,MEA was elected as Dy Secretary General. 5- Retirement age- Director (HR) told there is no movement at all to reduce the retirement age from 60 to 58. There was a rumour that MTNL/BSNL has been asked by DOT to consider the reduction in retirement age.

6-Telephone bill those who are staying in BSNL area- He assured that matter will be taken up  with BSNL to avoid disconnection.

7-Vacant Qtrs at Kalamboli-Director (HR) assured that he will pursue to rent out Navi Mumbai qtrs to outsiders.

Association maintains 100% transparency and honesty in the issues, and its efforts have always been to get the due rights of the executives.  Because of your support and faith, we have been able to create histories and achieve many land marks in the past. Now, we are making all efforts for getting faster promotion in MTNL.  Our efforts are to get introduced PSU promotion hierarchy by personal upgradation of post on time bound basis, because we are of the firm opinion that no rules can give much relief in reducing the stagnation in post based promotions.  Our efforts are also to get all vacant functional posts of executives filled up on regular basis by available recruitment rules. There are more than 700 posts of SDE and more than 350 posts of DE lying vacant for last so many years. In SDE cadre, last SCF DPC was held in 2009, but competitive quota was not filled up since 2001 and management did not agree our request to convert the competitive quota into seniority cum fitness because they did not want to go against recruitment rules. As per present SDE recruitment rules 1/3rd posts will be filled up through competitive quota and 2/3rd through seniority cum fitness, these rules are decades old which were adopted by MTNL and BSNL with minor changes. When management did not agree competitive quota to be transferred into seniority cum fitness even after three years persuasion, while many hundred posts of competitive quota were lying vacant, than Association started putting pressure to conduct the competitive exam as per available rules to fill up vacant post of SDEs of competitive and seniority cum fitness quota, because we did not want to let go many hundred posts unfilled for decades when stagnation in the cadre has already crossed 15 years. Now, process of filling all vacant posts of SDE has been initiated through seniority cum fitness and competitive exam.  Being the responsible Association, we managed study material for the JTOs who will be appearing in the exam on no loss no profit on the demand of the members, and also arranged classes free of cost for the officers irrespective of any Association. We believe, it is the duty and responsibility of the Association to provide such services to its members. These classes and study material are not only useful to the exam but also to upgrade the technical skill of the officers. But to our surprise, some negative forces are criticising this positive efforts of the Association only for misguiding the officers and fulfilling their vested interests, and also trying to create hurdle in these promotions.  Any negative step will not only deprive many hundred JTOs of 1993-94-95 year of recruitment from their legitimate right of promotion through seniority cum fitness and 232 JTOs who may be promoted through competitive exam from amongst the 1996 to 2005 batch JTOs, but will also delay the promotions  of the JTOs of 1996 onward.  Therefore, we appeal every one not to do anything which may create hurdle in the promotions for the sack of the cadres.

As far as DE/ Sr Manager cadre is concerned, Association will make all possible efforts to get all posts filled up on regular basis and to stop external recruitment in DE/Sr Manager cadre.

 

20.01.12 CHQ and Area office bearers meeting was held in room no 555 kidwai bhawan in which GS   elaborately explained the issues of promotions from JTO to SDE and SDE to DE and requested them to explain the issues to the members so that they can not be misguided by vested interest forces. Association will do its level best to stop external recruitment at E5 level because it will block the promotion prospects of internal officers which are already squeezed. Promotions of JTOs of 1996 and onward will also be made faster by exploring all possibilities, but they should not be misguided and carried away by propagandas and cheap slogans.

Meeting with CMD---SG along with Sr Vice president, Shri S.R.Singh, OS,Shri. R.K.Mudgil,DGS, Shri Sunil Kumar, treasurer, Shri Satyavir singh and AGS, Shri Sanjay kumar met CMD and discussed following issues.

1.     No external recruitment at E5 level---Association expressed its opposition for external recruitment at E5 level and informed him that Association has been opposing any external recruitment from the very beginning because there is requisite experienced talent available in the company to be promoted to the Sr management posts and such recruitment will block promotional avenues of executives which are already very tightened. CMD said that there is requirement of the company to recruit few young officers that is why only 40 officers are being recruited (20 internal and 20 external). He stressed to go at least one time for this recruitment, which can be reviewed later on. Association made its disagreement and informed him that Association will continue to oppose external recruitment.

2.     Surrender of BWA spectrum—CMD was of the same view that BWA spectrum should be surrender to get back Rs 4554/ crore from govt for the survival of the company.  He said efforts are being made to surrender the spectrum.

3.     Pension from Govt—He said that pension issues is to be fought together by Associations/unions and management, because it is very important issue for survival of company. He said efforts are being made to resolve the issue.

Issues related to convergent billing, and other services were also discussed in length. Regarding the problems in convergent billing system/CVCRM, he said that Issue is being taken up at the level of CMD, MTNL and CMD, Bell, and in last meeting some decisions have been taken to resolve the vendor related problems.

CMD was of the views that surrender of BWA spectrum, pension from govt and VRS are the three important issues for the survival of MTNL and sought Association cooperation in these issues.

Meeting with Dir (HR)—SG along with other office bearers had a meeting with Dir (HR) and following issues were discussed.

       1—No external recruitment for Sr Manager---Association strongly pleaded not to make external recruitment at E5 level because MTNL has its own talent with requisite qualification and experience which no external candidate will have. So there is no logic for going to external recruitment in the name of qualification and experience. External recruitment will block the promotional avenues of executives which are already much constricted.  SG also mentioned the agreement of Chairman (Telecom Commission) and MTNL management with the Association that recruitment will be made only at entry level i.e E2. Dir (HR) justified the need to go for external recruitment but said that RRs can reviewed later on. Association informed him in clear terms that external recruitment will be opposed by Association with all available means.

2—filling all vacant posts of DE on regular basis through seniority cum fitness—Association raised that 50% post of DE which were not filled up on regular basis on the ground that this 50% competitive quota was meant for ITS officers whose absorption process is pending, are now to be filled up on regular basis from amongst the SDEs/Sr SDE by seniority cum fitness because ITS absorption process has completed and no ITS DE has taken absorption in MTNL. After long discussion, Dir (HR)’s response was positive and assured to look into this matter.   

3---Time bound promotions with personal upgradation of post in PSU hierarchy---Association strongly raised the issue of time bound promotions by personal upgradation of post as assured in terms and conditions of absorption and also in the line of PSU hierarchy. This issue is being raised and discussed by Association for a long time. But this time Dir (HR) said that he has got a model of promotion scheme of PSU hierarchy which will be discussed with Association shortly to address the demand of the Association.

4. One time relaxation to the officers dropped in DPCs because of new bench marks—Association apprised him that still many officers are running pillar to post to get their CRs upgraded but have failed to get them up graded to match the new bench marks. This situation has come because of retrospective effect of the new bench marks. Association strongly demanded to review the cases and clear them by giving one time relaxation in the new bench marks. Dir (HR) asked SG to provide certain information regarding this matter so that some decision can be taken.

5. One increment on regular promotion in the same scale--- Association informed Dir (HR) that corporate office orders for regular promotion in the cadres of DE/CAO have denied the one increment to the officers who have been promoted in the same scale, while as per Gr B level promotion policy, one increment is to be given to the officers on their promotion in the same scale. After detailed discussion Dir (HR) agreed to revisit this case.

6.Issue of promotion of JTos of 1996 and onward was discussed and options were suggested to get faster promotion of left out officers through seniority cum fitness.

GS discussed following issues with ED, Delhi-

·       LA/offtg promotions in the cadre of SDE/DE/DGM-GS asked ED to issue the local promotion orders in these cadres against the vacant posts. Cases of SDE and DE cadres are already in advance stage . ED said that the issue of number of posts of DGM and GMs in Delhi/Mumbai and corporate office is under discussion in corporate office, after this decision, total chain of promotions of officers will be completed.  But after insistence of GS, ED assured to look into these cases.

·       New dolphin service connections to the officers—GS informed him that some new cases of dolphin service connections of JTOs/JAOs/AMs are pending for the approval of ED. GS asked him to approve these pending cases. ED said he has cleared some cases and would see other cases also.

·       Pending DPCs—Association asked GM (A) to expedite the screening of regular promotion from JTO to SDE and DPCs of financial upgradation for E3 to E4 and E4 to E5 including the reviewed cases of below bench mark. Later on AGM (DPC) informed that all DPC and screening work is being expediently, only some CRs for E3 to E4 are awaited and all DPC and screening work will be completed shortly.

Meeting with Secy/DOT on 30-12-2011:

GS,SNEA, GS and president/AIBSNL EA and GS/MEA met Secy/DOT. While thanking Secy/DOT for taking a very decisive action to conclude the process of absorption of ITS in a time bound manner, and thereby end the uncertainty existing in BSNL/ MTNL for the last about five years, Secy / DOT reiterated the resolve of the government to ensure that the process initiated by DOT reaches its logical conclusion as expeditiously as possible, of course, taking into account the magnitude of the issue and the crucial fact that operations of gigantic sized BSNL/MTNL are not impacted as far as possible while effecting this important organizational transition that is extremely critical for the growth of BSNL/MTNL.

Subsequently, the following issues were discussed.

A) Filling up posts of DGMs:

We apprized Secy/DOT that huge number of JAG posts is unfilled and thousands of eligible STS officers are available to fill up these posts. However, because of inexplicable reasons, BSNL management pleads its helplessness to promote STS to JAG because of some unwarranted restrictions imposed by DOT. The net result of all this is that hundreds of STS officers are retiring without getting promoted to JAG, even though abundant posts of JAG are available and a well defined mechanism in BSNL/MTNL MS RRs is envisaged. Secy/DOT was quite receptive on this issue and assured that he will discuss the issue with CMD and try to resolve it.

B) Encroaching upon the limited career growth of executives by recruiting 600 senior DGMs through new RRs:

Recruiting 600 senior DGMs through the provisions of new RRs is a direct infringement on the existing BSNLMS RRs and a serious attack on existing meagre promotional avenues of executives since such recruitment would mean directly utilizing 600 JAG posts, exclusively meant for career growth of Gr B / Gr A, and, in the process, also, creating another unwarranted functional cadre in the existing cadre hierarchy between JAG and SAG, thereby making promotion from DGM to GM almost impossible for executives within the organization, we apprised Secy / DOT who advised us to discuss the nitty gritties of new RRs and their implications on our career growth with CMD/BSNL/MTNL.

C) Payment of spectrum charges for spectrum in excess of 6.2 mhz by BSNL/MTNL:

We requested Secy/DOT that government should exempt both BSNL/MTNL from payment of additional spectrum fees for spectrum it holds in excess of 6.2 mhz since BSNL/MTNL has being meeting social obligations objective of telecom operations of the government by providing services in remotest rural areas at huge costs, and without any returns. Secy/DOT assured that all these aspects would be duly considered by government while taking final decision on the issue.

Board Meeting : Regarding E5 exam age relaxation etc.

      It is learnt that in the MTNL Board meeting held on dated 29 december 2011, MTNL Board has approved following things regarding E5 Exam issues-

1. For the exam being held this year the maximum age for departmental candidates has been extended to 55 years. For E5 exam to be held next time it will be 50 years . For subsequent exams it will be 40 years.

2.  B.E.(Mech) has been allowed as eligible qualification  for departmental candidates.

3.  Pay protection will be granted to those successful departmental candidates who are already in E4/E5 Grades.

4.  MTNL BOARD has also passed the RRs for E6 (DGM posts 40 in no. with max. age of 47 years) & E9 (GM posts 30 in no. with max. age 57 years) for one time recruitment of JAG/SAG/HAG level officers.

After UF meeting with CMD,MTNL, this issue has been discussed by CMD with Director (F) and Director (HR). It is now decided that MTNL will write to DOT [Jt. Secretary (T)] for providing administrative/financial approval. Director (HR). assured to send such communication to DOT within next two days.

     BSNL has promulgated  BSNL Special Lateral Direct Recruitment Rules-2011 for Senior Management Level (Telecom Operations) of BSNL Management Services for Recruitment for Sr. Deputy General Manager (Sr. DGM) and GM/PGM/CGM (Telecom Operations) in E6 and E9 IDA Scale ( of BSNL) . These  rules shall assume  force with effect from 26-12-2011 These rules shall be valid through one round of recruitment from ITS.Gp A officers and one more round from others ,if required.

Meeting with ED (WS) ---GS along with DGS, Vice president Sh P.K.Jain, CHQ Treasurer and Area secretary (WS) Sh Dilawar Ali met ED (WS) and discussed the various issues pertaining to the WS services and welfare issues of the executives working in WS unit. Issues related to the convergent billing project and problems aroused in mobile services after switch over of mobile services on this system were discussed in length. ED told that this problem is because of customization issue which is to be addressed by vender (BELL). He told that already CMD, MTNL and CMD, BELL is seized with this problem and trying to find out the way. Association asked him to make local arrangements to address the customer problems till the issue is resolved at the highest level for which Association is also pursuing with CMD. Issues of signalling and call drop etc were also discussed. It was also raised that old generators be replaced and all generators of BTSs should be in auto mode so that in case of power failure, generators can start automatically. ED agreed that the issues raised by Association are genuine, and assured to do something to improve the situation. He said that it is not true that MTNL mobile services are very bad. He informed that in a drive test it was found that there were 9 calls drop in Airtel network and 11 in MTNL network that too with the fact that Airtel  BTS are more than double of MTNL BTS. He also informed that case is in process to increase the BTS. Area Secretary Sh. Dilawar Ali raised many issues of executives related to Fin and Adm, which were noted by ED and DGM (HQ) WS who was also present in the meeting. ED assured to take action on the issues raised by AS. Issues related to the WS services will now be discussed with CMD.

General body meeting of Jorbagh Division—A general body meeting of Jorbagh division was held on 28-12-11 in Jorbagh exchange building which was attended and addressed by GS,DGS,OS,CHQ treasurer and Area Secretary (Central) Sh M.L.Sharma. GS in his address briefed the house about the current issues like repatriation process of GR A, promotions in SDE/DE/DGM cadres through seniority cum fitness and competitive exam and financial position of company etc. New divisional representative body was also elected in this meeting. Meeting of UF with CMD MTNL—Representatives of different unions and Associations of MTNL met CMD to greet and discuss the pension and revision of pension in MTNL on par with BSNL. CMD was briefed about the pension and revision of pension issue status and the efforts being made by UF at different level and requested him to further expedite the case.  He asked UF to provide him some points which legally justify the claim of pension in MTNL at par with BSNL so that he can impress upon the DOT to strongly take up the case with concerned authority to get this issue settled. During the discussion, CMD sought views of the representatives to improve the financial position of the company. In this brief interaction, GS, MEA asked CMD to surrender BWA spectrum to take back Rs 4534/- crore from DOT, Speedy implementation of FTTH project, early solution of the convergent billing problems, to make STM-1 CPE available in Delhi unit to provide higher band width leased lines and roll back of CDM services etc. CMD noted all points and was very affirmative for considering the proposals except roll back of CDM services for which he replied that we are earning twenty crore revenue from CDMA services and the maintenance cost is five crore so still it is profit making. Last Date for applying for Sr. Manager Competitive Exam extended to 20 January 2012

 HR wing has put up a Board note for increasing age limit & including B.Tech (Mech.) as eligibility qualification for the Sr. Manager Competitive Examination. Board meeting is scheduled on dated 29.12.2011, therefore  MTNL Corporate Office has extended last date for Filling of Forms for Sr. Manager Competitive Examination from 26 december 2011 to 20 January 2012.
