29-10-13 Meeting with Hon'ble MOC&IT Shri Kapil Sibal----A strong delegation of 200 members of MEA led by GS, Shri V.K.Tomar met Hon'ble MOC&IT Shri Kapil Sibal at his official residence 19 Teen Murti  Marg and greeted him by presenting bouquets and garlands. GS, MEA shared the dais with Hon'ble Minister and addressed the gathering recalling his earlier discussions on pension  and revival of MTNL and assurances given by Hon'ble Minister. GS whole heartedly thanked Hon'ble Minister on behalf of thousands employees of MTNL for his extraordinary efforts to see the recommendation of GOM which was constituted by his initiatives for revival of MTNL/BSNL and requested to get the GOM recommendation approved by cabinet . GS also raised the issue of CGHS option for MTNL employees and merger of MTNL and BSNL and submitted memorandum on these issues.

 Hon'ble Minister Shri Kapil Sibal addressed the gathering and explained how he analysed the MTNL/BSNL position after knowing the facts from us and understood that these companies are sick because of payment of 28ooo/- crore to Govt on account of spectrum charges which was not justified. He told he met to Hon'ble Prime Minister and asked to form GOM for the revival of MTNL/BSNL. He also said that  He has signed cabinet note tomorrow which will be sent to cabinet in next 8 to 10 days and assured that he will get it approved in cabinet. Hon'ble MOC&IT also said that he is also infavour of merger of MTNLand BSNL

27-10-13 GS, Shri V.K.Tomar attended and addressed the CWC meeting of SNEA(I), BSNL at Patna on 26-10-13.GS, MEA in his address thanked CWC and   rank and file of SNEA in particular and BSNL Unions/Associations in general for supporting us in our struggle for pension at par with BSNL. GS also recalled the achievements of ENC (Executive Negotiating Council) in 2002-03which ensured improved pay scale in BSNL and standard pay scales in MTNL and also compelled MOC&IT to give assurance in parliament not to make discrimination in payment of pension in MTNL and BSNL.GS also stressed on combined efforts by both the Associations to ensure revival and survival of BSNL/MTNL and implementation of standard pay scales in BSNL.
   
27-10-13 Meeting with ED Delhi--GS, Shri V.K.Tomar, CS Shri Sunil Kumar, AGS, Shri D P S Chaudhary met ED on 24-10-13 and discussed following points-

1- pending list of looking after promotions in DE cadre- we requested him to issue the list at earliest. ED assured that looking after promotion orders will be issued shortly. We also asked him to issue local promotion orders in other executive cadres in Telecom, Civil/elect and Finance wing. He assured to collect information of vacant posts in different cadres and appropriate action to fill up vacancies.

2-Shortage of material, steps to increase revenue were also discussed in detail. He informed that now all required store items are available and efforts are being made to make uninterrupted supply.  He stressed that to increase revenue, all officers and employees will have to ensure that faults are cleared same day and if not possible same day, next day all faults should be cleared. We also appeal all officers to ensure that no fault remains unattended same day. Do all efforts to clear all faults same day, it can only increase revenue. Keep in mind that out come of our efforts to get pending benefits of 2nd PRC and implementation of 3rd PRC will largely be influenced by the revenue generation.

3--Telephone Bill Distribution---ED informed that he has taken the decision to distribute telephone bills through post. Now staff can be fully utilised for providing the new connections and proper maintenance of services.

24-10-13 GS writes to Director (HR) to constitute a committee to deliberate and decide on our demand of time bound functional promotions upto jt GM in CPSU cadre hierarchy as assured in terms and conditions of absorption. <<letter>> 
   
24-10-13 Meeting with Member (Fin), DOT----GS along with Shri Praveen Passi, Vice President CHQ met Member (Fin) Mrs Annie Moraes on 23-10-13. We enquired about the cabinet note on pension and BWA refund. She informed that cabinet note on BWA refund has been sent to cabinet but cabinet note on pension issue is still to be sent.She was very reactive on our concern on pension and BWA refund. She said that these issues alone can't make your company revived and survived, but you will have to increase your revenue through your services. She further said that govt support can never survive any company, it is you who can only get your company survived by increasing your revenue. She also said that with same spectrum of 12.4 MHZ, other private companies are earning many time more revenue than MTNL. To our reply that there are no funds in MTNL for the growth and maintenance of the services, she said that your company should go for loan for this purpose. Later we met to a concerned officer of DOT establishment, who said that cabinet not on pension issue will be completed in 2/3 days and will be sent to PMO for its approval before sending it to cabinet.
   
24-10-13 Meeting with GM(HR)--GS along with Shri Parmil Gupta, Vice President CHQ and Shri Rajkumar Sharma, Jt CS met GM(HR) and discussed following issues.
  1.  Promotion case of official language cadres--we briefed the issue and provided the bullet points as sought by Dir (HR)
  2. JAOs seniority case and their promotion to AO-We asked him to expedite the case so that their long pending promotion orders can be issued. He assured early action on the issue
  3. Representation of R.B.Yadav JTO, Mumbai and other similar cases of option of pay fixation for those who were on leave during the period of one month of exercising the  option for pay fixation-case was briefed to him and representation forwarded by GS  handed over to him. <<GS letter>>>
  4. Constitution of committee for CPSU cadre hierarchy for time bound functional promotions.--issue was briefed to him and the copy of letter written by GS to Dir (HR) handed over to him for action on his part
  5. Regular DPC of POs (E2-non tech)--GM(HR) said that some information has been sought from Mumbai unit. Association requested him to expedite the case because many of these officers who are officiating in this cadre are going to be retired shortly.

24-10-13 Meeting with GM (Fin), Corporate Office--GS along wth Shri Parmil Gupta, Vice President CHQ and Shri Rajkumar Sharma, Jt CS met GM(Fin) CO and discussed following issues. 1--Action on the request of retaintion of 3 CAOs who have been posted in Mumbai unit on their promotion from AO to CAO--GM(F) said that file of this case is with him and will discuss with Dir (Fin). Association asked him to take early action on the representations. 2--ACP case of civil wing of Mumbai unit-today he cleared the file and sent to Dir (Fin) 
   
23-10-13 GS along with CS Delhi met a concerned officer of BSNL Corporate office to discuss the pending issue of RSTC bill payment of MTNL employees residing in BSNL area. He informed that in a MOU signed by both the companies, it has been decided that both the companies will pay telephone bills to other company for all service connections w.e.f Nov 2013, and a committee will be formed to decide the pending bills for the period before Nov 2013. Committee is likely to be formed by the end of this week.

20-10-13 Meeting with CMD--GS, Shri V.K.Tomar along with Shri S.S.Nanda, GS, RTOWA & Shri R.K.Mudgal met CMD on 19-10-13 and discussed the issues of abnormal delay in payment of terminal benefits to the retired employees and GPF withdrawal. We expressed the anguish of employees on this abnormal delay. CMD informed that he has strongly asked the concerned officers to resolve the issue of GPF withdrawal and regarding payment of terminal benefits, he said efforts are on to arrange the money.  He also informed that cabinet note on pension issue and BWA refund is expected to be sent to cabinet by DOT next week.

16-10-13 MTNL Mazdoor Sangh's convention on  MTNL's dwindling financial condition and revenue generation---Convention was held in Shah Auditorium on 15-10-13 in which GS, MEA Shri V.K.Tomar was also guest speaker along with CMD, MTNL Shri A.K.Garg, Director (HR) Shri Sunil Kumar and other BMS leaders. GS MTNL Mazdoor Sangh Shri Dharamraj Singh raised many reasons of today's financial condition of MTNL and held MTNL management responsible for that. GS, MEA while appreciating CMD for certain initiatives and efforts to get  policy decisions in favour of MTNL like pension, BWA refund, synergy of operation with BSNL & initiatives in land monetisation, also held management responsible for declining revenue generation through its operations because of lack of store items and  maintenance funds  as well as lack of monitoring at higher level and inherent tendency of hiding facts at all levels. But appealed all employees to do their best to increase 15% revenue with available resources through its efficiency because our survival lies with the survival of company. Director (HR) also appealed to generate more revenue by doing his job with full dedication and satisfaction and hoped that company will come back to good condition. CMD  apprised the audience how he visualised the revival of company and fixed priorities, and expressed satisfaction that as he visualised four important issues for revival of company are going in the same way- four priorities were, Pension, BWA refund, merger or synergy of operation with BSNL and land monetisation. He hoped that he will be able to get the settlement of all these issues before he retires .He said that if we could generate 15% more revenue through its operations than company can be turned around.  He made sincere appeal to all to increase Rs 500 crore more revenue.  After the session, GS MEA discussed the issue of bill distribution in Delhi unit and expressed concern over delay realisation of revenue because of delay bill distribution. CMD asked GS MEA and President/GS MMS to come with a concrete proposal to resolve the problem.
   
15-10-13 GS writes to CMD regarding time bound financial upgradation from due date if executive was clear from vigilance angle during the period of review (Five Years) as well as on the date when time bound upgradation was due but vigilance/disciplinary case erupted in the subsequent period and remained pending till the meeting of DPC/screening committee. <<letter>>
   
12-10-13  GS met Director (HR) on 11-10-13 and discussed official language staff promotion cases and non availability of  AM(HR)/Mktg/Legal/CS promotion channel and scrapping of E3 RR.. GS asked Dir (HR) to spare some exclusive time for discussion to find proper solution of the issues. He asked GS to provide the bullet points to GM (HR) so that issues can be well understood before any further discussion.
   
12-10-13 GS along with OS, Delhi Shri C.P.Baliyan met Jt GM(HR) on 11-10-13 and discussed pay anomaly cases and pending pay fixation option cases as well as pending medical floater cases for the period of  April 2012 to March 2013. He informed that financial concurrence of flaoter cases has been given by Dir (Fin) and approval of pending cases will be sent to Delhi and Mumbai units by 3rd week of Oct. He also informed that Civil ACP case has been sent to Finance again for their approval. Later on Case was discussed with CAO(IF) Corporate Office who informed that file has been cleared and will be sent to HR wing shortly.
   
12-10-13 In the meeting with GM(HR) and DGM(P), the issue of fixation of pay of Sr AO/ Sr SDE after implementation of MTNL time bound financial up gradationin  was also discussed in detail. Association stressed on giving fixation to these officers as per DOT ruling by virtue of which they were entitled for fixation of pay in Sr AO/ Sr SDE scale as per FR 21 (a) 1 (a). GM (HR) and DGM (P) were convinced. later on issue was briefed to finance people of corporate office. Case is under consideration in Finance wing.

10-10-13 Meeting with GM(HR)-- GS along with AGS, Shri D.P.S.Chaudhary, WP Shri R.K.Mudgal & Jt Secretary Shri Sunil Sonkar met GM(HR) on 09-10-13. Jt GM(HR) and DGM(Pers) were also present in the meeting. Following issues were discussed.

Seniority cases of telecom and finance wing-Association briefed GM(HR) on pending seniority cases and requested him to expedite the cases because these cases are pending for quite long time and officers are waiting for their legitimate right of promotion. GM(HR) assured early action

Increment to officers on regular promotion to Sr Manager who are already in E5 scale by virtue of financial upgradation--  Association has been pursuing this case for a very long time that denying increment to these officers by taking reference of Sr management promotion policy is illogical because these promotions are the part of promotion policy of Gr B level officers. Now after long persuasion, GM(HR) and Director (HR) has recommended the case and sent to finance.

Review of executives' Promotion policy to ensure time bound functional promotion upto E7--  Association asked GM(HR) to process the case so that deliberations can be made on this issue with higher management. Association pleaded  that because of poor promotion aspects in MTNL, there is very high attrition rate and a large number of newly recruited officers in different wings have left company. We also brought to his knowledge that there are no promotion channel available for AM(HR)/Mktg/CS/Legal because no RRs are there for promotion to Dy Manager in these disciplines.  We also suggested that time bound function upgradation by scraping E3 RRs can resolve the problem of all disciplines and will help in attracting and retaining the best talent in company and will also put an end to all court cases. Jt GM(HR) and DGM (Pers) also supported our view point.

Child Care Leave-- DGM(P) informed that information sought from  Mumbai unit is still awaited.

Referendum and recognition of Executives' Association--It was informed that draft recognition rules are being prepared. After finalisation of recognition rules draft, Associations will be asked to give their view point on recognition rules.

09-10-13 Meeting with Member (Services)--GS, Shri V.K.Tomar along with ACT Shri Arun Dixit met Member( Services), DOT on 08-10-13 and inquired about the status of cabinet not on pension and BWA refund..He informed that cabinet note is still with DOT because some queries were raised by Finance wing. Main query was that MTNL board approval is for formation of trust while GOM has approved pension from govt as in BSNL, so approval of MTNL board for pension from Govt as in BSNL is required before sending it to the cabinet. MTNL has sent fresh approval of MTNL board for pension from govt as in BSNL.  Now cabinet note is being prepared which will be sent shortly.
   
06-10-13 CHQ and Circle Office Bearers Meeting--Meeting was held in 555 Kidwai Bhawan on 05-10-13 which was attended by CHQ/  Circle Office bearers, Area Secretaries. GS briefed the office bearers how MEA played a vital role in getting the break through in two important issues of Pension from Govt and BWA refund. MEA was the only Association which was focusing on these two important issues for last many years and making the point before the govt that with out the resolution of these two issues, MTNL revival can not be think of. Ultimately, GOM acknowledged the  very necessity of resolution of these issues for the revival of the MTNL and approved the pension from Govt as in BSNL and refund of BWA spectrum charges which was exclusively raised and pursued by MEA. GS expressed full confidence in getting the cabinet approval on these issues.

But office bearers were clearly told that resolution of these two issues is not sufficient for the revival and survival of the company, and govt support can not be expected  again and again. The formation of GOM for revival of any PSU comes once in many decades. We have to utilised this opportunity  and make all possible efforts to get company revived and bring it back to profit making PSU before 2017 so that we can get our IIIrd pay revision implemented with all benefits  including PRP and other benefits of IInd pay revision in the days to come after the settlement of pension and BWA refund.

More revenue generation remained the main point of discussion in the meeting and it was discussed hours together . Office bearers raised the problem of maintenance funds. GS clarified that this problem has been discussed at all levels including CMD and Director (Fin), but at present management is not in position to spare more funds because of cash crunch in the company. For the time being, we will have to make extraordinary  efforts to increase more revenue with the available resources. There is always the scope to improve the things 10 to 15 % by human efforts with available conditions and resources. We are the only affected stake holder of the company, blaming any body will not make any difference in the present situation. So, we will have to give our 100% and make best efforts to increase the revenue to see the revival and survival of the company.

It was also pointed out by many office bearers that there is lack of monitoring at all levels including GMs, which is affecting the performance of the company and in turn loss of revenue. It was also informed by some office bearers that there is false fault clearance on the instance of senior officers just to save their skin before higher management.   Lack of monitoring and false fault clearance are the prime reasons  of customer dissatisfaction and  loss of revenue . GS  and CS told   office bearers to tell all officers not to make any false fault clearance, and asked them to expose the wrong practices of hiding the facts. These wrong practices are  making company hollow and sick. So all members of MEA in Delhi and Mumbai are appealed to expose the wrong practices so that remedial actions can be taken to improve the system in MTNL.

Office bearers raised many problems and gave  suggestions to improve the services, which were noted down, Association will take up all these problems and suggestions at appropriate level

GS asked all Direct recruited JTOs/AMs and departmental JTOs not to be restless over their stagnation in the cadre for a long time. Association is committed to stream line the promotions in all cadres and making efforts to scrape the E3 RRs so that all JTOs/JAOs/AMs can get their first functional promotion with financial up gradation. Our efforts are to see time bound functional promotion in all disciplines upto Jt GM. 

GS apprised house why a recognised majority Association is required for the betterment of the company and executives. He informed that after MEA's persuasion management is going to finalise the recognition rules for executives' Association. Office bearers were asked to enrol majority of members with MEA before the membership verification takes place in MTNL. As per the information provided by Area secretaries, MEA's membership is more than 80 % in most of the areas and it is more than 90% in some of the areas. Area Secretaries and CHQ/Circle Office bearers were asked to convert this membership into  paid membership and come with full preparation in CEC meeting of Delhi circle which will be held in last week of October.

   
06-10-13  Nehru Place Division GB meeting--GB meeting was held on 04-10-13 in Nehru place Exchange building. Mtg was attended by more than 50 officers. GS Shri V.K.Tomar, CS Shri Sunil Kumar, AGS Shri D.P.S.Chaudhary, ACT Shri Arun Dixit, Circle President Shri S.R.Singh, Circle Org Secretary Shri S.N.Rathi Area Secretary Shri Karamvir Singh & DS Shri Amrish Kumar addressed the meeting. GS in his address explained the all the issues ranging from pension, BWA refund,  VRS, promotion policy, DPCs, seniority cases to the financial condition of the company and revenue generation. GS stressed that govt support  alone can not get company revived/survived, we will have to make our extraordinary efforts to increase our operational revenue with the available resources till the settlement of pension and BWA refund after which Association will press the management to make more funds available for the maintenance of the services. GS also stressed not to make false clearance of faults because of any pressure from any level and exposed the wrong  practices and shortfalls in the the working in field units so that remedial action can be taken to improve the system.

INCREASE IN IDA W.E.F 1.10.2013:According to calculations based on All India Consumer Price Index for June, July and August 2013, IDA is to increase by 6.6% w.e.f. 1.10.2013 from 78.9% to 85.5%.

26-09-13 Meeting with Director (Finance)---GS, Shri V.K.Tomar, AGS, Shri D.P.S.Chaudhary & CS Shri Sunil kumar met Director (Fin) Shri P.K.Purwar today and discussed following points
  1. Pension & BWA issue status and further actions in this regard
  2. Payment of terminal benefits of retired employees
  3. Payment of GPF withdrawal
  4. payment of medical floater cases of serving employees
  5. Creation of corpus for terminal benefits of MTNL employees
  6. Revenue generation

Detailed discussion was held on these issues. Director (Fin) elaborately explained all the issues very honestly and transparently. He told that MTNL has gone for Rs.1000/ crore loan which is expected to be materialised shortly and after receiving the  payment from bank, all pending payments of the employees will be made. But he was very categorical in telling that if we all will not make our sincere efforts to increase the revenue , any help from govt can not save the company. Even after the settlement of pension and BWA issue, we need about Rs1500 crore more revenue to run this company. He appealed to increase the revenue. He said that with 132% staff cost, it is not possible to run the company, so he hinted that VRS/CRS is on the card and is expected to be decided through GOM.. He informed that in spite of the approval of GOM on pension issue, Ministry of Pension & Pension welfare is writing against the GOM decision and are not in favour of pension in MTNL as in BSNL. So we will have to keep our fingers crossed till the approval of cabinet. Cabinet note from DOT will be sent next week to cabinet.

Com S N Prasad - President (CHQ)  along with Com PH Naikar - VP (CHQ), Com HS Upadhyay, Working President Mumbai, Com GP Yadav , Joint CS, Com Virendra Singh - AGS, Com Jawalikar - ACS, Com VS Singh - AS (N), Com SM Khandekar - VP Mumbai and Anil Kumar met hon'ble MOC&IT Shri Kapil Sibal in Mumbai and  expressed the gratitude towards him for his kind and sincere efforts towards addressing the issue of revival of MTNL including resolution of Pension in MTNL on the line of BSNL. A detailed discussion was held on how we could succeed in getting the desired results on critical issues which are very important for the revival of the company and secured pension to the employees. He informed that Hon;ble Finance Minister and Hon'ble MOC&IT were very positive on the pension issue and ensured approval of GOM. He appealed that now employees have to do their best to increase the revenue. Association assured him that officers will not leave any stone unturned to increase the revenue.

GS also raised some HR issues on which he assured positive action and asked to again discuss with Dir (HR). Regarding retention of CAOs in Delhi who have been posted in Mumbai on their promotion from AO to CAO, CMD assured positive consideration .

GS, Shri V.K.Tomar along with Shri R.K.Mudgal, Shri D.P.S.Chaudhary,& Shri Satyavir Singh met Member (Services) on 13-09-13 and extended him sincere thanks and gratitude on behalf of thousands of officers of MTNL for his efforts to get approval of GoM in MTNL pension issue which is being delt by him in DOT. He said that it was the combined effort of all stake holders and apprised us how our hon'ble MOC &IT Shri Kapil Sibal and Hon'ble Finance Minister Shri P.Chidambram were keen to see the revival of MTNL and settlement of pension issue. He also told us that CMD, MTNL Shri A.K.Garg has played a vital role in resolution of pension issue. He also appreciated the role of Association in reaching to this point of settlement. We expressed our concern for early gazette notification of amendment in 37(A) pension rule. He said that after receiving the approval of minutes of GoM meeting, cabinet note will be sent to the cabinet next week. As per normal practice, matter is taken up in cabinet in third week from the date of receipt of cabinet note. So cabinet approval may take three to four weeks . And in normal practice another 15 days for gazette notification.

He also informed that left out agenda of GoM will be discussed in next meeting. VRS, restructuring, revival plan etc are expected to be discussed in next meeting .

  1. Shortage of store items---shortage of store items  like drop wire, clip instruments  etc were raised by Association. ED agreed that some time there is delay in receiving the delivery of store items from vendors because of delay payment to them. He informed that  now delivery of drop wire and clip instruments is expected in next week.  He also expressed his unhappiness over the poor response in recovering the unutilised drop wire of disconnected connections and asked Association to  pursue with the field officers to put more efforts to recover the unutilised drop wire.  
  2. Filling unfilled vacancies of DGM/DE/CAO/EE/SDE--Association demanded to fill up the unfilled vacancies in these cadres on local basis till regular promotions are issued by corporate office. ED assured to  fill up the unfilled vacancies at the earliest.
  3. Issue of permission for property purchase and other issues of officers pending in ED office were also discussed. ED assured to expedite the pending cases in ED office.
  4. Issues related to the maintenance of services and revenue generation etc were also discussed in length, Association gave many suggestions to increase the revenue
29-08-13  GS met Jt GM (HR) on 27-08-13 for follow up action on pending issues like seniority cases of Telecom/Civil/Finance, ACP case of Civil JTOs, regular promotion of personal officers (E2-non Tech) etc. He informed that all the cases are in process and will be decided shortly.  GS also spoke to GM(Fin) corporate office to put up the case of retention of CAOs who have been transferred to Mumbai.
   
26-08-13                            CMD addresses to employees

CMD has addressed the employees of the company through his open letter to  increase the revenue by Rs.500/ crore this year above previous year and has prepared a seven point agenda to increase the revenue. He has also mentioned Managements' efforts to resolve the issues like pension, BWA refund etc and hoped to bring the company back to its good shape shortly. All employees/officers are appealed by this Association to go through the appeal and seven point agenda of management to increase the revenue by implementing the points suggested by management. It is our company which can be turned around by the combined efforts of all of us. It is the right time to jump upon the opportunity and do our best to bring our beloved company to the old glorious days. Association is committed to take care of all concern of the officers.

26-08-13   Pension agreement was signed on 23rd August in the chamber of CMD, MTNL, where Dir (HR) and Dir (Fin) along with Jt GM(HR) were also present. Before signing the agreement, GS, MEA sought the clarification on the line--' in case, MTNL decides to pay pension on MTNL scales, the difference will be borne by MTNL'. It was clarified by CMD/Dir (HR)/Dir (Fin) that it was the exact language written in GOM minutes so it was to be reproduced in the same manner in agreement, but management further clarified that pension is paid on last drawn pay as per pension rules so MTNL will pay pension on MTNL scales and only arrangement of govt liability and MTNL contribution is to be made. Dir (HR) wrote a letter to GS, clarifying the position of MTNL. CMD also said that if required relevant orders may be issued in the days to come. 

After the Agreement, Dir (HR) called the GS and President of MEA and MTNLMS in his chamber and discussed about the revenue generation and handed over the CMD appeal and seven point agenda to increase the revenue.

GS also raised the issue of left out cases of  DGM(T) adhoc promotion which were not considered because of contempt case in BSNL. GS clarified that MTNL is not the party in that case than why officers of MTNL have been denied their legitimate right of promotion. Dir (HR) said that let the individual affected officers represent their case, we will consider.

Issue of recognition of  Executive Association and granting the applicant status till referendum takes place. Dir (HR) asked GS to provide the relevant orders of BSNL on this issue and assured appropriate decision.

Pension agreement between Association and MTNL Management.

Today, Association has signed the agreement on pension issue with the MTNL management to be sent to the GOM for its approval in the next meeting likely to be held in this month only. The terms of agreement are as follows !

1-This agreement is for the erstwhile govt employees absorbed in MTNL who opted for combined pension scheme. (Prorata-optee and Direct recruitee employees/Officers will not be covered under this agreement)

 2-The treatment of disbursement of pensionery benefits of erstwhile employees of Govt absorbed in MTNL may be  considered on the same lines as that prevailing in BSNL.

3.The liability of Government towards pensionary benefits of absorbed employees of MTNL may be restricted to the equivalent scales of similarly placed employees in BSNL. In case, MTNL decides to pay pensionary benefits on the basis of pay-scales in MTNL, the liability arising from the same will be borne by MTNL.

4-BSNL and MTNL shall move towards pay-scale parity at the time of next pay revision.

Copy of Signed agreement will be posted on site shortly.

 Managment has also clarified the liability of difference of payment of pension on MTNL scales.

22-08-13 GOM meeting minutes regarding Pensions of MTNL employees at par with BSNL have been issued by DoT & the same received by MTNL Corporate Office yesterday evening.  GS discussed with CMD regarding further course of action.
   
19-08-13 Meeting with Director (HR)--GS met Dir (HR) and thanked him for issuing the adhoc promotion orders of DGM(T)/DGM(Fin) and inquired about the minutes of the GOM. Dir (HR) informed that minutes are still awaited but are likely to be received in a day or so. GS also discussed the issues of seniority cases of telecom and finance stream and provided the inputs to Dir (HR) on these issues. GS also suggested the mechanism to be adopted to implement the time bound promotion upto E7 by personal up gradation of posts by scrapping the present RRs. Issue of filling competitive quota of Sr Manager post through SCF was also discussed . GS requested Dir (HR) to get the detailed report from the concerned sections of HR wing on various pending issues including the Hindi translators promotion case, so that detailed discussion can be held to resolve the pending cases.

Director (HR) also raised the important issue of revenue generation and informed that he has prepared seven points agenda to increase the revenue, which will be circulated amongst all units for implementation.  He discussed the whole seven points agenda with GS and asked to get it implemented in field units. He said that one time revival package from govt can not survive the company for along time until and unless we  generate the revenue from our resources.   All officers are appealed to put their 100% efforts to generate more and more revenue by optimum utilisation of available  resources.

Mr. Rajshekhar Rao was present on behalf of the Applicants. Ms. Jyoti Singh, Senior Advocate was present on behalf of the Respondents. However, as there was no time left the Bench did not hear the matter and has adjourned it for hearing on 21.08.2013.

 
   
17-08-13 GB Meeting of TY area--Area GB meeting was held on 17-08-13 in Kadkad Dooma exchange building. Meeting was attended by about 80 officers, which was addressed by GS, Shri V.K.Tomar, CS, Shri Sunil Kumar, CT, Shri Satyavir Singh, Org Secretaries Shri S.N.Rathi & Shri C.P.Baliyan, ACSs Shri Ashwani Kumar Singh & Shri R.S.Chauhan, Area President Shri Dharmendra Gautam, Area secretary Shri J.P.Sharma, Div Secretaries, Shri Laxman Singh, Shri Dheeraj Gupta, Shri Rajvir Singh & Shri P.L.Tandon. Members raised working problems of the area and raised their voice against the mismanagement, lack of concern, in competency, misbehaviour and failure of the GM to maintain the services of area. Services of area are worst affected because of the working of the GM (TY). GS and CS in their address asked members not to tolerate any misbehaviour of any officers and to fight against the wrong doing by any one in the area to provide the efficient services to the customers, and assured to take  up the issues of shortage of materials and other issues related to the services with the higher ups.

GS, in his address reminded the strength of the unity of members which has made possible many historical achievements like, E2,-E3--pay scales, time bound financial up gradation upto E7, 30% fitment, and now pension from govt as in BSNL and many more achievements to maintain the dignity and respect of the members and asked them to have faith in yourself and the Association. Issues like promotion prospects, regular DPCs, pay revision, 78.2% fitment, PRP etc and above all the financial viability of the company which is ultimately the key of resolution of all the issues. GS assured best efforts of the Association to ensure the best carrier prospects of executives in MTNL and resolution of all other issues raised by Association and appealed members to give their best to improve the services of the company and increase the revenue by 14%. GS informed the house that Association is make all possible efforts along with the MTNL management to turn around the company and hoped that if every thing goes well and we do our best, company can be turned around in the days to come.

   
17-08-13 Meeting with MTNL Direct recruits officers--
GS explained the need of solution of the pension issue. He told the resolution of pension issue at par with BSNL will not only ensure the secured pension to the DOT recruited officers/employees, but will also wash away the losses of more than Rs 1500 crore from the balance sheet. So it is the key issue to bring out the company from deep crisis and turn it around. As far as the concern of parity of pay scale with BSNL for direct recruits is concerned, GS told that Association has earlier taken up the issue with management  not to touch the pay scale of Direct Recruits and pro-rata optees, which was acknowledged by management. Let the minutes come, this time also we will take care of the concern of direct recruits. As far as 30 % superannuation benefit is concerned, it is our issue and we have written to the management and will fight for it. 78.2 % DA merger is also priority issue which will be fought in the days to come. time bound  promotion by personal up gradation of post up to E7 level is being rigorously pursued. CCL issue is also being pursued for settlement as in other govt departments and PSUs.

GS told the members to participate actively in Association Activities and take the responsibility. They were also asked to give their valuable suggestions on various issues .

07-08-13 Meeting with PGM(O)--CS Shri Sunil Kumar, AGS, Shri Dharampal Chaudhary, CT, Shri Satyavir Singh, ACT (CHQ) Shri Arun Dixit & Area Secretary (East) Shri K.K.Panaday met PGM(O) and discussed the issues of shortage of material, bill distribution and misbehaviour of subordinate staff in field units etc
   
05-08-13 Meeting with Member (Services), DOT---GS, Shri V.K.Tomar, AGS, Shri Dharampal Chaudhary & CS Shri Sunil Kumar met Member (Services) and thanked for his efforts to ensure Pension in MTNL at par with BSNL. We requested him to expedite the process to  get the minutes of the GOM issued so that further process can also be expedited. He said that draft of the minutes will be sent by DOT to Hon'ble MOC&IT most probably by tomorrow which in turn will go to  Hon'ble Finance Minister for his approval. It is expected that minutes will be released in the beginning of next week.  After the agreement with Unions/Associations, next GOM will approve the pension case, which in turn will go to cabinet for its approval and than amendment will be made in pension rule. Next GOM may be expected by the end of August,13.

We also requested him to see that things are properly taken up in next GOM to ensure positive decisions on other issues concerning the revival of the company. He was very hopeful of the positive decisions by GOM on other issues in next meeting.

   
05-08-13 GS along with Com R.K.Mudgal met Jt GM(HR) & DGM (PERS) Corporate Office for follow up action on pending issues like, promotion orders of DGM(T) and DGM(Fin), Civil ACP case, XEN (Civil) DPC,  increment on regular promotion to Sr Manager, JAO seniority, SDE seniority cases etc.
   
05-08-13 GB Meeting of T/H (WS) division was held which was attended by large number of members. GS, AGS Shri Dharampal Chaudhary, CS, Delhi Shri Sunil Kumar, ACSs Shri B.L.Singh and B.K.Sharma, Area Secretary (WS) Shri Dilawar Ali addressed the meeting. GS elaborately explained the pension issue and other issues related to the promotion and financial viability of the company. Area President, Shri J.K.Verma conducted the meeting. Sh. Prateek Bhargav, Divisional secretary organised the meeting.
   
 

 Meeting with CMD

MEA representatives along with Delhi recognised union (MTNLMS) representatives met CMD MTNL on 2nd August, 2013 and expressed their thanks and gratitude for his sincere and untiring efforts in getting  approval of GOM for pension in MTNL as in BSNL. CMD was satisfied with his extraordinary efforts and out come of GOM. He said that he could do his best because Association/union allowed him to work peacefully on this issue and had faith on management. He also said that this could be possible because of sincere efforts of all stake holders including Associations/Unions/Management/DOT and above all the will of our hon’ble Minister Shri Kapil Sibal to ensure secured pension to the MTNL employees.   Assurance given by Hon’ble MOC&IT on the floor of parliament in a reply to the starred question on our agitation in 2003 helped a lot to GOM  to reach to the conclusion of pension in MTNL at par with BSNL. GOM has agreed as

1-payment of Pension to MTNL absorbed employees by Govt as in BSNL subject to the condition that Unions/Associations will make agreement for the parity of scales in next pay revision e.i in 2017 and

2-Govt will be liable for pension to MTNL employees on BSNL scales and difference of pension payment will be born by MTNL,

3-MTNL will make pension contribution to the govt according to FR116 on last drawn pay

4-Govt will return/adjust the amount paid by MTNL towards pension owing the govt liability since 2001 with 8% interest.

He said that minutes of the GOM will be issued by DOT in a day or so, which will be circulated in all concerned Ministries/ Departments and MTNL for agreement with Associations/Unions. After the Agreement, case will be processed for amendment in Rule 37A to include MTNL in the clause which ensures the govt liability to pay pension to BSNL employees and also to change the date of effect of rule 37A from Sep 2000 to Nov 1998, the date of absorption of MTNL Gr C & D employees.  

He asked Association/Union representatives to make agreement at the earliest after the minutes of GOM meeting are issued by DOT, so that case may be processed well in time in DOT for amendment in rule 37A.

In the GOM meeting on 1st August, only  MTNL pension issue was discussed and decided, for rest of the issues of MTNL/BSNL including BWA spectrum charges refund and other issues related to the revival of state owned companies will be discussed in next GOM meeting.

CMD appealed Association/Union representatives to increase 14% revenue and assured that if we could do this, he will make MTNL, a debt free company. He hoped that present MTNL management will definitely improve the condition of the company in the days to come with the support of officers/employees.

GS, MEA also discussed the following issues with CMD, MTNL

1—Regular/adhoc promotion orders of DGM(T)CMD informed that he has already approved the case and orders should have been issued by now. He asked GS to meet Dir (HR) to know the delay in promotion orders.

2—Child care leave—CMD said that case has been discussed in ECM, and there is opinion of the management that initial orders of govt that female employees will be allowed two year child care leave with full salary if they have exhausted their other leaves, can be implemented in MTNL. Association/union representatives stressed on implementation of amendments in earlier orders of govt which allows child care leave even without exhausting other leaves. CMD said it will further be deliberated in management.

 

3—Problems in present Indoor medical scheme through insurance company—Association/Union representatives raised that present medical scheme needs to be replaced with our own medical scheme because it is creating lot of problems to the employees. CMD agreed that scheme needs to be reviewed and asked Association/Union representatives to explore other options like shifting to CGHS scheme.

 

Meeting with Dir (HR)after the meeting with CMD, MEA representatives met Dir (HR) and discussed the delay of promotion orders of DGM(T). He said that there is a contempt case in BSNL on the seniority of officers who are in the zone of consideration of these promotion orders, so MTNL is examining the implication in MTNL and after that orders will be issued. We also raised the issue of seniority of JAO and early issuance of seniority list, he assured to expedite the case. We also told him that as desired by him to give the detail brief on some of the issues related to executives, GS, MEA has written some letters on different issues and some more issues will also be written shortly. So, we asked him to study these issues so that after some time, issues can be deliberated and settled. He assured necessary actions on the issues raised by Association. He also appealed to increase 14% revenue. He further told that he will also come out with the steps required to increase revenue shortly.

We have learnt that GOM has agreed for payment of pension in MTNL by govt as in BSNL with certain conditions like parity of scale with BSNL in next pay revision i.e. 2017 and  difference of pension to be paid by MTNL. We will upload the full details after discussion with MTNL management.

NCOA meeting with Secretary DPE (Department Of Public enterprises)---Shri K.Ashok Rao, President, Shri Baby Thomus, Secretary General, Shri Satish Deshpandey, WP, Shri V.K.Tomar, GS, MEA/ DSG NCOA, Shri Anil Kumar, GS, ITI, Shri Mohan Kavelakar, GS , GSY (Goa Shipyard) met Secretary DPE Shri O.P.Rawat  and Joint Secretary Shri Pavadia on 22nd July, 13 and discussed following points.

1.       PRP to all executives in CPSEs where PRP has been implemented—NCOA representatives  raised the issue of discrimination in paying PRP in the name of bell curve formula according to which 10% Executives are compulsorily kept below par to deny PRP. This denial of PRP to 10% Executives has created lot of heart burn amongst them where PRP scheme has been implemented. Secretary assured to look into the matter and review the scheme if required.

2.       Pay revision and 50% IDA merger--   NCOA demanded pay revision w.e.f 01-01-2012. Secretary made it clear that a cabinet committee headed by Shri P. Chiddambram, Hon’ble Finance Minister will only take the decision regarding pay revision of central govt employees and CPSE executives. As far as 50% IDA merger is concerned, matter has been referred to finance ministry and if govt takes any decision regarding 50% DA merger for central govt employees than only it will be considered for CPSE employees.

3.       Implementation of 1997 and 2007 pay revision in some of the sick PSUs- Secretary informed that matter is under consideration of DPE and BRPSE.

4.       Revival of sick PSUs—NCOA raised the issue of revival of sick PSUs like ITI and HMT etc whose revival cases have been referred to BRPSE. Secretary said that in last 5 years, 17 PSUs have been revived by BRPSE and the current cases of revival of PSUs which have been sent to BRPS are being considered seriously. One thing which he underlined was that in all the cases where PSUs were revived, it was possible only after putting in place the strong leadership of the management.

We also met to Shri Nitish Sen gupta, Chairman of BRPSE (Board of Revival OF PSEs) and suggested the ways to get the sick PSUs revived. He asked the NCOA to give suggestions in writing. When we raised the issue of financial condition of MTNL/BSNL, He said two things only, one MTNL and BSNL are required to be merged and second to win the confidence of customers by improving the services. He said customers’ psychology is that MTNL/BSNL does not provide better services. He stressed to change this psychology of the customers.

Meeting with Dir (Fin)----GS along with other office bearers met Director (Fin) Shri P.K.Purwar on 18-07-13 and discussed following issues.

1RSTC billing problem of the MTNL employees living in BSNL area and vice versa ---We raised the problem of the employees living in BSNL area and facing discussion of RSTC connections because of non payment of old bills. Dir (Fin) said that this point has been included in the agenda of meeting for synergy of operation between MTNL and BSNL and was discussed in the meeting which was held three days before in which MTNL has suggested that from April 2013 onward both the companies should make company to company payment for the entitled calls limits of the employees and bills for excess calls be only sent to employees. BSNL is yet to take a decision on this proposal. We asked him to take a decision on old pending bills for the period before August 2007. He agreed that there should not be any discussion on old pending bills and assured appropriate action on this matter.

2—Seniority cases of Accounts and finance wingwe explained the cases related to the seniority of officers in Accounts and finance wing. He assured to look into the seniority cases and decide as per rule.

3—DPC for DGM (Fin) and retention of CAOs in Delhi who were transferred to Mumbai on their promotion—We requested to hold the DPC for regular/Adhoc promotion in the cadre of DGM (Fin) at the earliest and retain the CAOs who have been  transferred to Mumbai because of non availability of vacancies in CAO cadre in Delhi. Dir (Fin) was positive on giving due promotion to the officers and told that DPC is being conducted shortly which is already scheduled on 20th July. Delay is because of some seniority issues. But for retention of CAOs, he was of the opinion that officers should be transferred between Delhi and Mumbai and vice versa like in any other PSUs. Our plea was that today, company is passing through a very crucial juncture where we need a motivated and dedicated work force which can give its 100% percent to improve the condition of the company. We are not even being given our legitimate rights like 78.2% fitment and revised perks and allowances, than why to take our peace of mind and put our families in problem. A disturbed employee can never give his/her best, so transferring officers between Delhi and Mumbai will prove to be counter productive, which company can’t afford in today’s condition. After our argument Dir (Fin) appeared to be convinced to some extent and replied that he will see what best can be done.

4—One increment on regular promotion in the same grade-- We explained him the issue and requested to take a positive decision on this issue as and when it comes to him for his concurrence. He assured to look into this matter with positive view.

5—Time bound financial upgradation from due date if no vig case is pending on that day but erupted before DPC—This issue was also explained to him. He assured that decision will be taken keeping in view the decision of BSNL and guide lines of govt on this issue.

6—Pension issue—He said that inspite of the fact that the proposal of a combined trust in DOT for Gr C&D and A&B has been circulated by DOT amongst all concerned  departments for their comments, MTNL management in present circumstances after first GOM meeting is pursuing for pension from govt as in BSNL and efforts will be made in next GOM meeting which is scheduled to be held on 30th July.

10-07-13 GS met Member (Services) on 10-07-13 and discussed about the next GOM meeting and pension issue. Member (Services) informed that  comments on issues like pension and BWA refund have been sought from different departments including departments of the  Ministers who are the member of GOM.  5  departments have sent their comments and 6 are yet to send. Reminder has been sent to all left out departments with the request to send their comments in a week time. GOM meeting will be held after getting the reply of all departments.
   
10-07-13 Meeting with GM (Fin) Delhi Unit--GS, Shri V.K.Tomar, CHQ Vice President Shri Praveen Passi, Circle Secretary Shri Sunil Kumar & Jt Circle Secretary Shri Rajkumar met GM (Fin) on 09-07-13 and discussed following issues.
  1. Looking after promotion in CAO cadre--Association raised that there are 17 vacancies available in Delhi and requested to fill up these vacancies on local officiating /LA till regular promotion orders are issued by corporate office. GM (Fin) assured to look into this matter. This issue was also raised before ED, he  also assured to look into this matter.
  2. Transfers in Account and Finance wing as per rotational transfer policy only--Association raised that some time officers are transferred without any justification and criteria on pick and choose basis and said that any such action of the administration will be strongly opposed by this Association.
  3. Review of below bench mark cases of officers in finance and Account wing--Association raised that there are some cases of below bench marks which have not been properly reviewed by concerned officers and requested him to intervene in such cases and take appropriate action at his level. He assured appropriate action at his level.
  4. Submission of life certificate by retired employees in banks ---Association raised problem of retired employees of submitting life certificate in MTNL twice a year while it is submitted by all govt employees in banks once in a year. Association asked GM (Fin) to take up this issue with other higher authorities  to decide this issue as in other central govt departments. He assured appropriate persuasion at his level.
   
10-07-13  GB meeting  of RG area--GB meeting was held in RG administrative building on 09-07-13. About 100 members attended the meeting. GS, Shri V.K.Tomar, WP Shri R.K.mudgal, CHQ Vice President Shri P.K.Gupta, AGS, Shri Sanjay Kumar, Circle Secretatry , Shri Sunil Kumar, Org Secy Shri C.P. Baliyan, Jt Circle Secretary Shri Vinay Sundriyal, ACSs  Shri Prashant Kumar, Shri D.S.Rathi  & Manjeet Prasar and Area President Shri N.P.Singh & Area Secretary Shri S.C.Tyagi attended and addressed the meeting. Members raised many problems related to the cable network and non functioning of AC units in switch rooms which are affecting the total working of the area and no one is taking it seriously at higher level.  GS and CS in their address assured the house to take up thses issues at appropriate level and explained about the Circle and CHQ issues and appealed members to be united do their best to get company turned around.

GS said that if pension issue, 78.2% fitment and BWA refund is not settled in a reasonable time, Association will fight organisationally.

05-07-13 GB meeting of Corporate Office--GB meeting was attended by large number of officers of corporate office which was addressed by GS, CS,  Org Secy   Shri C.P.Baliyan,  Shri Arun Dixit CHQ Asstt Treasurer  & Shri Sanjay Kumar, Area Secretary (CO). A large number of young officers were present who expressed their concern regarding poor promotion avenues of officers in MTNL . Officers of HR, Mktg, CS, Legal were very frustrated because they have no RR for their promotion to next post. GS briefed about the present condition of the company and many other issues related to the executives and also assured that Association will do its level best to see the better promotion prospects of officers in the company. GS also appealed all the officers to do their level best to bring the company out of the present deep crisis and hoped that united efforts of management and Association  can turn around the company.
   
05-07-13 Meeting with GM (HR)--GS along with CHQ Vice President Shri Praveen Passi & Jt Secretary Shri R.S.Maan met GM (HR), Mrs Rajni Taneja on 04-07-13. Jt GM (HR) Shri M.K.Saxena and DGM (Pers) Shri Kulwant Chand were also present in the meeting. Following points were discussed.
  1. DPC for adhoc/regular promotion in DGM (T)/DGM(Fin)--

it was informed that DPCs are being scheduled in next week.

2--JAO seniority case--we expressed our concern over abnormal delay in circulating the seniority list of JAO according to the provisions in RR i,e Training centre marks. GM (HR) informed that case is with her and decision will be taken shortly.

3--DPC for EE (Civil)--We informed her that screening report is still pending in units so a strong reminder is to be sent to units. She assured to do the same

4--Child care leave--She informed that case has already been put to the ECM.

5--One increment on regular promotion in same grade--Officers who are in E5 grade are being denied one increment on there regular promotion to the post of Sr Manager. This case has been raised by our Association and is under consideration in corporate office. GM (HR) informed that case has been put for decision at higher level.

6--Financial upgradation on due date if no vig case is pending on that date but vig case is come up before DPC--We were told that Dir (Fin) Mrs Anita Soni had given the noting that decision should be taken in accordance of Govt rules. We explained that Govt rules are for functional promotion and if case is pending on DPC date, benefit will not be given on that day, but our case is regarding financial upgradation which is on time bound basis which has nothing to do with the DPC date. GM (HR) assured to put the case again on the basis of our argument.

7--Regular promotion of  looking after Sr Managers (T)/ Fin/Civil/Elect after converting competitive quota vacancy in SCF quota- GM (HR) replied that issue is still being deliberated in a committee constituted for this purpose-

8--Promotion of Hindi translators to the executive cadre--Response was not positive. Issue will be further discussed with Dir (HR).

   
05-07-13 General Body meeting of Transmission Area--GB meeting of Transmission area was held on 04-07-13 in 555 Kidwai Bhawan New Delhi. About 100 officers attended the meeting which was addressed by Shri V.K.Tomar, Shri R.K.Mudgal, Shri D.P.S.Chaudhary, Shri Sunil Kumar Shri Satyavir Singh, Shri C.P.Baliyan & Shri Birgesh Kumar Sharma, Area Secretary (Trans). Members raised many issues regarding non availability of store items, scrapping of old OFC cables, redeployment of CWG equipments, issues related to MM, RSTC bill payment in NCR etc. GS in his address explained the issues related to the financial viability of the company, pension, promotion . 78.2% fitment and other HR issues and assured to take up the issues raised by members with the appropriate authorities.

We extend best wishes to Com G.L.Jogi, Com R.K.Mudgal, Com H.C.Pant, Com J.P.Sharma and all comrades who retire today on superannuation, for a happy and peaceful retired life. We thank all our beloved comrades for their great contribution in the organisation and the department and congratulate them on reaching this pre decided day of superannuation with good health carrying the affection and respect of thousands of comrades of MTNL and BSNL.  

Com G.L.Jogi’s Contribution in the resolution of cadre issues and struggle for the revival and survival of MTNL/BSNL is unparallel. His recognition and acceptance is not only in telecom sector but in other sectors also. He is national trade union leader who has strongly established his able leadership on many fronts. We wish he will always be there to guide us.

Com R.K.Mudgal’s contribution in the Association is great. He is very hard working and dedicated soldier of the Association who fearlessly fights for the cause of the members. We will always seek his services for the Association. We wish for his good health.

          Grand and successful CWC Meet

Central Working Committee (CWC) meeting of MEA was held in beautiful circular hall of CETTM, Mumbai on 20th and 21st June, 13 under the president ship of Shri S.N.Prasad, CHQ President, MEA. Meeting was inaugurated by Shri A.K.Srivastav, Sr GM (Trg) CETTM and Shri P.K.Adhikari, GM (Adm) Mumbai unit. Both the officers addressed the meeting and stressed on revenue generation and hoped for bright future of the company and assured their efforts to provide better trg and fast settlement of other welfare issues. Shri G.L.Jogi, President SNEA(I) and Shri M.S.Adsul, Circle Secretary SNEA (I), Maharashtra Circle attended and addressed the CWC meeting.  Shri Jogi reminded the achievement of the erstwhile JETA/TEOA and now MEA in the upliftment of the cadre and many more issues related to the officers and the financial viability of the company. In his address he declared that MEA and SNEA will jointly take up the issue of merger of MTNL and BSNL. After the presidential address by Shri S.N.Prasad and Address by GS, Shri V.K.Tomar, both Circle Secretaries of Delhi and Mumbai, Shri Sunil Kumar and Shri J.J.Mathias placed Circle Secretary report and declared their paid membership with the assurance to further increase it before next CWC meeting which will be held in Delhi.

Shri G.L.Jogi President, SNEA and Shri R.K.Mudgal CHQ Working President, MEA are going to retire on their superannuation on 30th June 2013.  CWC felicitated farewell of these great leaders. CWC wished for their happy and prosperous life and recalled their great contribution in the Association and gave farewell on their retirement from department but wished they will be always in our hearts and continue to extend their services in the Association.   

General Secretary gave brief on each and every agenda item, after detailed discussion on every item, following decisions were taken.

1--Pension from govt as in BSNL--   GS explained that Association is pursuing for the pension from govt as in BSNL. After detailed discussion, CWC decided that if GOM does not take appropriate decision to decide secured pension in MTNL as in BSNL, Association will fight for resolution of secured pension from Govt as in BSNL.

2—Pay fixation with 78.2% IDA w,e,f 01-01-2007—House unanimously resolved that pay fixation with 78.2% IDA is our legitimate right to get 100% IDA neutralisation as per govt orders, it cannot be left unsettled for a long time. So Association will have to fight for its early settlement.

3---Financial viability of MTNL and revival plan—This issue was discussed for more than three hours. Members raised many problems and gave suggestions to improve the quality of service and revenue of the company. After detailed discussion, GS assured house that Association will make all possible efforts to get the company revived and explained how Association took up the policy issues like BWA refund, Govt Pension liability, which are now the part of revival plan in GOM (group of Minister). GS asked members to do their level best to increase the revenue with the available resources and assured that Association will fight to see the revival of the company through govt policies.

4—Merger of MTNL and BSNL—House unanimously resolved that MEA along with SNEA will take up the merger issue and pursue with other unions/Associations to come together to fight for merger of MTNL and BSNL.

5---Carrier progression of Executives’ in MTNL—CWC felt that present carrier progression of executives’ in MTNL is very poor and it needs to be improved so that fast promotion upto E9 can be ensured. CWC decided that the earlier proposal of MEA of time bound personal upgradation of post with financial upgradation as per CPSU hierarchy is further strongly to be fought with management. CWC further decided to fill up all vacant post of Executives’ in all disciplines on regular basis and promote all looking after officers on regular basis.

6-Recruitment of JTO/ AM(T)—JTO(T) is very important cadre and plays vital role in the development , operation, maintenance and plg of the company, but there is acute shortage of JTO/ AM(T). In today’s scenario, young and qualified officers are required for the revival and survival of the company. So, Management is to be pursued for recruitment of fresh JTOs.

7—Recruitment of non-unionised technical supervisory cadre with the qualification of diploma in engineering--     In today’s competitive era, where we have to provide the best basic and value added services like BB, LC, basic telephony services to our customers by giving them 24X7 home service. We need a young technical staff for field services. Therefore, We need to recruit a cadre like TTA with qualification of engineering diploma.

8—Diversification of business—CWC resolved that Association should pursue with the management for diversification of business in the areas like entertainment, education, IT etc

9—Issue of Faculty and non-faculty members in CETTM—In CETTM, officers are categorised as faculty and non-faculty members. Non- faculty members are not getting special pay. CWC decided to take up this issue at appropriate level.

10—Proper maintenance of CETTM/ITTM--  CETTM/ITTM are now generating substantial revenue, but they have no maintenance fund and due to lack of fund its maintenance is totally ignored. If it is properly maintained and more business is generated, revenue of CETTM/ITTM can further be increased.  So the issue of separate maintenance fund for CETTM/ITTM is to be taken up with management.

11--Many more pending HR issues like seniority issue, child care leave, civil ACP, DPCs in different cadres, anomaly cases, increment on promotion in the same scale etc were discussed and decided to further pursue with the management. GS thanked management for conducting many DPCs in Different executive cadres and also for deciding rebate on BB connections for MTNL employees.   

12--Review of new bench marks---Very Good grading in new bench marks for promotion in executive cadres is required to bring down to good. This is further to be taken up with the management to review these new bench marks.

13--Referendum/ membership verification---Association has to strongly take up the issue of membership verification of Executive Association so that a majority Association  of Executives'can be decided in MTNL

Association will write on various decisions taken in CWC to the management shortly.

We appeal all officers to give thier 100% for improvement of services and revenue generation by optimum utilisation of available resources. We have to come forward to turn around the company.

21-06-13 Com V.K.Tomar, GS, MEA, Com G.L.Jogi President SNEA & Com Sabestin, GS, SNEA met CMD BSNL  on 18-06-13 and discussed the issue of pending RSTC bill payments of MTNL/ BSNL employees for the period before August 2007. Association pleaded for waiving of these pending bills. He told a meeting of MTNL and BSNL officers will be held shortly to sort out this problem.

18-06-13 GS spoke to GM (HR) and asked her to issue the CAO regular promotion orders before 20th June so that JAOs, who were posted from Delhi to Mumbai on their promotion to AO, can be retained in Delhi against the AO posts which will be vacated after regular promotion in CAO cadre. She assured orders will be issued in a day or two.
   
 

Meeting with CMD---GS, V.K.Tomar, WP, RK.Mudgal & CS Sunil Kumar met CMD on 15-06-13 and had a detailed discussion on the GOM (Group of Ministers) meeting in which CMD MTNL Shri A.K.Garg made presentation on financial condition of MTNL and raised vital issues of Pension  and refund of BWA spectrum charges. We stressed before CMD that in this GOM, pension in MTNL from Govt as in BSNL should be stressed instead of through the proposed pension trust because trust will put additional financial burden on the company in the long run. He said that he was trying in that direction only and a fresh proposal is being prepared for pension from Govt as in BSNL for next GOM meeting, which is likely to be held very shortly. He said first GOM meeting was very positive and hoped that he may get some important issues settled through this meeting which will put MTNL in the rising trend and help in turning it around.

We also strongly demanded to implement 78.2% IDA fitment in MTNL after its implementation in BSNL. But CMD and Dir (Fin), Shri P.K.Purwar, who was also present in the meeting, expressed their reluctance to implement 78.2% IDA fitment on the ground of financial crisis in MTNL. A detailed discussion was held on this issue but we strongly maintained that fitment with 78.2% IDA is our fundamental right which can’t be left unsettled for a long time. CMD said that let us first concentrate on the next GOM meeting to get pension and BWA spectrum charges refund case settled, fitment issue will be further discussed in the days to come.

We also discussed the following cases-

1.       Reimbursement of pending medical floater cases—We raised that there are many medical floater cases pending in corporate office for a long time and the employees, who have paid for their treatment from their own because of pending approval by TPA in ED/CMD floater cases, are still waiting for their reimbursement. CMD assured to take decision on such cases 

2.       DPC for regular promotion in the DGM (T) and DGM (F) cadre--- We requested CMD to get DPC conducted in DGM(T) and DGM(FIN) cadre for regular promotion at the earliest. He instructed concerned officers to decide the DPC date at the earliest. Regarding DGM (Fin) DPC, it was informed that screening report from Mumbai unit is still awaited.

3.       Promotion of AM (HR)/Mktg/Legal/CS—We again took up this case with CMD and asked him to consider the ways to get these officers promoted to next cadre. These officers are not getting their first promotion to Dy manager because of non-availability of RRs for DM promotion. CMD assured to look into this matter.

GoM to decide on BSNL, MTNL revival, expected to meet on June 11

 

06-06-13 In view of the importance of Telephone bill distribution, this Association and Majority union of Delhi discussed the issue and felt that bill distribution is the most essential activity to collect the revenue of the services rendered to the customers and it can not be left unrealised. But union representatives said that management had assured them to provide extra staff in the field units for maintenance of services and bill distribution. ED had also informed us in the meeting that efforts are being made to provide some more staff in the field units so that maintenance of services and bill distribution can be done properly and smoothly. But pending implementation of the decision should not come in the way of bill distribution.  All officers and employees have to ensure timely distribution of bills.

New Director (Finance) Shri Pravin Kumar Purwar Joins MTNL on 01-06-2013, Association meets him on 04-06-13.

GS, Shri V.K.Tomar along with CHQWP Shri R.K.Mudgal, CHQ Vice President Shri Parveen Kumar Passi, AGS, Shri D.P.S.Chaudhary, CS, Shri Sunil Kumar, CT Shri Satyavir Singh met new Director (Finance) Shri Praveen Kumar Purwar and welcomed him by presenting the bouquet. During brief discussion Association apprised him of the present financial condition of the company and the issues of priority to get the company turned around. We briefed him on the importance of pension from govt as in BSNL, refund of BWA spectrum, revenue generation through proper maintenance of services for which funds are required. We stressed on release of sufficient maintenance funds. We assured him our full cooperation and support to get the company turned around. Dir (Fin) said that no one alone or a group of individuals can turn around the company, but everyone in the company will have to work hard to improve the condition of this company. He said he will do his level best to improve the situation and assured free and frank discussion with the Association on all matters related to the company and the welfare of executives.

 

   
 

Meeting with ED DelhiGS, Shri V.K.Tomar, WP, Shri R.K.Mudgal,CS ,Shri Sunil Kumar & CT, Shri Satyavir Singh met ED 0n 04-06-13 and discussed following points

1.       Distribution of telephone bills- Association raised that telephone bills are not being distributed in the areas. This is not only making customer annoyed but our hard earned money is not being collected. No business can be done without recovering the price of its product. ED said that bills are to be distributed by area lineman only and the discussion of union with administration has been misunderstood that bills will not be distributed by the concerned lineman. Earlier instructions to distribute bills by lineman are to be followed. He asked Association to tell its members to get bills distributed by their lineman. GMs are also being instructed to ensure bill distribution.

2.       Shortage of store items ---ED informed that matter is being pursued with the corporate office to expedite the tendering process to procure the store items.

3.       Billing of leased line circuits—Association pointed out that leased line billing starts after getting the certificate of satisfactory service from customer, which normally comes after a long gap of 2 to 4 months and we lose the revenue of this period. Association suggested that a maximum of one month time should be given to customer to give certificate. ED assured to look into the matter.

4.       Delay decision in restoration of cable network—Association raised the issues where we lost a substantive amount of revenue because of delayed decision by administration in restoration of cable network. ED explained the hurdles in taking the decisions in govt organisation but assured that he will take quick decisions on his part and try to get the process expedite.

5.       Filling of vacant posts of  DGM/DE/EE through LA promotions till regular promotion orders are issued by corporate officeED  assured to issue the local promotion orders in these cadres after assessing the vacancy position and field requirement at the earliest.  

6.       Rising temperature in equipment roomsWe raised the issue of rising temperature in switch rooms and MLDN. ED instructed Chief Engineer (Elect) to take immediate n/a to resolve the issues related to the rising temperature in equipment rooms.

7.       Many other issues related to the improvement of services and increasing revenue were also discussed.

MTNL's March quarter loss widens to Rs 1,985.93 cr

State run telecom service provider Mahanagar Telephone Nigam Limited (MTNL) has reported an increase in its operational revenue to Rs 918.6 crore for the quarter ending March 31, 2013, up 10% from Rs 835 crore reported in the previous quarter and up 8.96% from Rs 843.1 crore reported in the same quarter last year.

The telco however saw a significant increase in its losses during the quarter, reporting Rs 1,985.9 crore loss, a 68% increase from Rs 1,182 crore loss in the previous quarter and a 44.48% increase from Rs 1,374.5 crore in the same quarter last year.

29-05-13 Meeting with GM (HR) ----GS along with CS Com Sunil Kumar & AGS Com Dharampal Chaudhary met Jt GM (HR) & DGM (Pers) for follow up action on various issues like DPCs, seniority cases, one increment on regular promotion to Sr Managers, child care leave, Civil ACP, E2-non technical regular DPC etc. Later on 28-05-13, we met to  GM (HR) and discussed the issue of converting MT quota into SCF quota and filling all available posts in Sr Manager cadres on regular basis in all disciplines. She said that a committee has been constituted to look into this matter and first meeting of committee is scheduled today i.e 28th May. We raised that the present RRs are DOT RRs adopted by MTNL, which are required to be changed in the PSU hierarchy so that faster promotions can be ensured, and also requested her to include this aspect in the terms and conditions of the committee. DPC for regular promotion in DGM(T) cadre is expected in 2nd week of June.

Farewell of Shri Kuldeep Singh, Ex CMD/Dir (Tech) and Mrs Anita Soni, Director (Fin)---Association gave  farewell to Shri Kuldeep Singh who joined as Member (TADSAT) after serving as Dir (Tech) and CMD in MTNL, and to Mrs Anita Soni, Dir (Fin) who is going to be retired on 31st May,2013 on  superannuation. Farewell was given in a beautifully well organised Delhi CEC of more than 125 office bearers in a beautiful auditorium in TEC building. Function was also graced by  Shri  A.K.Garg CMD, MTNL and Shri G.L.Jogi President SNEA(I).  Association appreciated the role of  Shri Kuldeep Singh and Mrs Anita soni in implementing the 30% fitment in MTNL and their sincere efforts to revive MTNL and also to resolve pension issue as well as for maintaining good industrial relations with Association. Both the officers recollected their memories of important decisions and events during their long journey in MTNL and appreciated the role of our Association on many fronts and said that association has a vital role play in getting the company revived and survived.  CMD, MTNL Shri A.K.Garg appreciated the role of both the board of Directors in company and said he will continue to  make all out efforts to get the company revived , and appealed  to one and all to increase 10% revenue. He said that if you get 10% revenue increased, I will get everything from Govt to get company revived. CMD and both the outgoing board of directors were positive on MTNL’s revival and survival and hoped that good days of MTNL will come back , but everyone will have to work hard for it. GS, MEA assured full support to CMD in his endeavours to get company revived and  pension issue resolved.  

CEC MeetingCEC meeting was conducted in CTO auditorium in which many issues related to MTNL services, circle issues and CHQ issues were discussed. Area Secretaries submitted reports on area activities and membership. CS Com Sunil Kr briefed house on circle activities. GS Com V.K.Tomar briefed house on various issues related to financial viability and HR issues.

22-05-13 Meeting with CMD--GS along with  AGS Com D.P.S.Chaudhary met CMD on 21-05-13 and thanked for regular promotions issued by corporate office in different executive cadres and also requested to consider the 111 SDE posts vacated after recent promotion orders from SDE to DE and till date resultant posts of retirement for further promotion from JTO to SDE so that the left out JTOs of 1995 & onward can be promoted and 18 year stagnation can be reduced. We also reiterated our demand  to fill the 50% competitive quota in STS posts of all disciplines through seniority cum fitness. CMD's response was very positive and hinted to fill up some percentage of STS competitive quota through seniority cum fitness.  we also requested for early DPC for regular promotion in DGM cadre. 
   
22-05-13 GB meeting of SS&Electronic Area--Meeting was held on 21-05-13 in 555 KBN which was addressed by GS, CS and Area Secretary Com Vivek Goel. GS in his address explained all the issues related to revival of MTNL, pay ,pension & promotions etc and appealed the members to do their best to improve the revenue. Issues like pay revision in 5 years in CPSEs, revival of sick PSUs, Pension and post retirement medical benefits, PRP etc and organisational matters were discussed. CMD, GSL (Goa Shipyard Ltd) addressed the inaugural session. 
   
16-05-13 Meeting with Dir (Fin)--- GS, Com V.K.Tomar, AGS, Com D.P.S.Chaudhary, CS Com Sunil Kumar, CT Com Satyavir Singh met Director (Fin) and discussed the following issues.

1--Secured Pension from Govt--She informed that cabinet note is being prepared in DOT to ensure secured pension with the govt liability to the MTNL employees and MTNL management is in close coordination with DOT to ensure secured pension and approval of revival plan from GOM.

2--Cancellation of transfer orders of JAOs who were transferred to Mumbai on their promotion to AOs--

She informed that the proposal of the Association to extend the relieving time of 40 days of these officers and hold the DPC for promotion from AO to CAO is being considered so that required vacancies in AO cadre are made available to consider the posting of transfered officers in Delhi.

3 Pending medical floater cases-We also raised the issue of pending medical floater cases of Delhi and Mumbai unit. We asked her to give the  approval of these cases at the earliest to avoid the hardship faced by employees.

respondents sought some time to argue the matter as the leading Counsel Mr. V.K. Rao has been elevated as a Judge to the Hon'ble High Court of Delhi. In view of the same, the matter was mentioned in court today and the Hon'ble Tribunal has listed the same for final hearing on 16.08.2013.

After long persuation of this Association, Corporate Office has decided the pay anomaly cases where a Junior executive who got first financial upgradation on or after 01-10-2004 under Gr B Time bound promotion policy and then post based regular promotion, is drawing more pay than his senior executive who got post based promotion on regular basis prior to implementation of the said policy. <<Corporate Office Order>>

                              Congratulations!

Corporate Office has issued regular promotion orders of 111 officers in the grade of Sr Manager (Telecom)/ DE. We are very thankful to the management for retaining all officers in their circles on promotion . We also extend our sincere thanks and gratitude to whole HR wing for their tireless efforts and hard work for conducting different DPCs and issuing promotion orders in different executive cadres in minimum required time.

03-05-13 Corporate office has sought the data regarding female employees having children below 18 years of age in Delhi and Mumbai unit to implement the child care leave in MTNL in accordance of Govt orders in this respect. <<letter>>
   
03-05-13 Meeting with CMD--- GS along with CS Delhi Com Sunil Kumar met CMD on 03-05-13 and discussed following issues.

1. Secured Pension--Association reiterated its stand of secured pension from govt and made it clear that if the govt guarantee of payment of pension is not spelt out clearly that govt will be liable to pay pension to the employees absorbed in MTNL, we will be forced to resort to strong protest action . CMD  honestly explained his efforts in this direction and mentioned about his meeting with Hon'ble MOC & IT Shri Kapil Sibal on this issue. He told that after his presentation, MOC &IT was quite positive and asked the DOT officers to move the case in this direction. CMD assured that he will not accept any dispensation until and unless it safeguards the interest of employees of secured pension with govt guarantee to take liability to pay pension to MTNL employees. 

2. DPCs in different executive cadres- He assured  sincere efforts of the management to complete all DPCs in executives cadres at the earliest. 

3. SDE (T) to DE (T) promotion orders--He has cleared the file, orders will be issued in a day or two. Delay in approval was because of some exercise to avoid dislocation of officers on their promotion to DE.

4.Filling of all DE/XEN/CAO and DGM post through SCF on regular basis-Association argued for filling all DE/CAO/EE posts on regular basis through SCF by doing away the competitive quota in the light of the fact that absorption process of all Gr A post including ITS has been completed and 50% posts of STS/JAG cadres are lying vacant which are being manned through looking after arrangement, resulting the promotion of officers to the post of DE/EE/CAO and DGM at the verge of their retirement when they are left with the time only to complete their retirement papers, and many ITS officers are working in MTNL unwillingly who always think of their rehabilitation plan, so this situation is not good for the health of the company. CMD appeared convinced with our arguments and assured to discuss this issue in length after the completion of on going DPCs.

5. Funds for maintenance---Association brought the alarming situation to the knowledge of  CMD that because of non availability of funds for the payment of vendors, they have refused to support and cooperate for the maintenance of services. We also apprised him of the non availability of funds for day to day maintenance work.  He said that he is aware of this situation and trying to come out of this crisis. 

6. Calling ITS officers on deputation to work in MTNL--Association opposed this process of calling ITS officers on deputation to MTNL and asked to meet the requirement from amongst our own company officers.

7. Regular promotion in DGM cadre instead of adhoc promotion-- We apprised CMD that officers who are going to be promoted on adhoc basis in the DPC scheduled in this month are going to complete requisite length of service for regular promotion in the month of June,13, so instead of going for adhoc promotion, they should be directly promoted on regular basis. CMD said let this DPC be conducted, we will promote them again on regular basis when they complete the requisite service.

Review norms for growth of state-run telcos: Parliament Panel.......With telecom gear procurement guidelines delaying network expansion, a Parliamentary panel today asked the government to ease norms so as to ensure growth of state-run telecom firms like MTNL and BSNL.

1-DPC in different executive cadres--

SDE (T) to DE promotion orders--DPC has already been conducted and orders will be issued after CMD returns from Mauritius on 25th April.

JTO (T) to SDE (T) --Screening reports of both the units have been received and  most probably DPC will be conducted in Ist week of May.

DE to DGM (T) and CAO to DGM (F)--Screening report of both the units have been received in corporate office and most probably DPCs will be conducted by 15th May,13.

Regular DPC for personal officers (E2 non-Tech)--Case has been marked to Jt GM(HR) for n/a.

2--Child care leave---She assured that case will be shortly put up for further action at higher level.

3. Case of one increment on regular promotion in the cadre of DE/CAO/EE--She said that case is in process and decision is yet to be taken l.

4. Clarification on the issue of date of effect of time bound financial up gradation from the due date if there is no disciplinary case on that date but erupted after due date at the time of DPC.--Case was marked to Jt GM (HR) to put up for further action.

5--Anomly cases (reference case of Shri Vivek Goel, SDE)---Decision has been taken on the anomaly cases and sent to finance for concurrence.

6--Issues of official language cadres--She said HR section is seized with the official language cadres issues and working on them.

7.Problems related to medical scheme --GS informed GM (HR) about the problems being faced by officers from the TPAs particularly in Mumbai and requested her to send some responsible officer to Mumbai to listen and short out the problems. She assured appropriate action.

MTNL Mumbai got STAY ORDER of Bombay High Court through Writ Petition No

578 of 2013 against BEST’s claim of Arrears of Rs 20.82 Crore. BEST had claimed

an arrears of Rs 20.82 Crore w.e.f. the year 2000/2007 for LT / HT Connections

respectively due to conversion of Electricity Tariff from Industry to Commercial

United Forum of MTNL Unions & Associations met Member (Services), DOT .We discussed about the MTNL Pension issue and apprised him of our serious concern regarding secured pension and viability of MTNL as an organization which has bearing on the security of service of MTNL working employees. Our fear is real under the background of the move to impose existing Rule 37A provisions of perpetual pension liabilities on MTNL which is already in red. Member (Services) gave patient hearing. He assures that he firmly stands in favor of100% security of pension, family pension and other pensionary benefits including revision of pension of MTNL employees. He also informed that Hon’ble Minister (C & IT) has shown keen interest in this respect.

05-04-13 GS's discussion with CMD---in a brief talk of GS with CMD, following issues were discussed.
  1. DPC in different executive cadres--GS asked CMD to conduct the regular DPCs in different cadres at the earliest, because there are some officers who are going to be retired in this month only. CMD himself was very interested to conduct the DPCs at the earliest, he asked GS to get the screening report of Delhi unit so that the DPC process can be started immediately. He informed that he has asked ED Delhi to send the pending screening reports of different executive cadres at the earliest. He assured GS that there will be no delay in corporate office in conducting the DPCs and issuing regular promotion orders.
  2. Concessional broad band connection to MTNL/BSNL/DOT employees-- CMD told that Case has been put up to him and assured that decision will be taken in a day or two.
  3. Business opportunity after Hon'ble high court decision to stop Airtel 3G services--CMD said that after high court decision, Airtel will have to stop its 3G services shortly, so it is an opportunity to increase our BB and 3G data card connections. He asked GS to tell all officers to grab this opportunity and do their best to increase our broad band and 3G data card connections. So all officers are appealed to jump to make all efforts to bring the Airtel 3G customers, whose 3G services will be stop shortly, in MTNL network by offering BB and 3G data card or 3G mobile services.  If you find any problem to offer and provide services to  customers, let the Association know so that CMD's intervention can be sought.

After the open session in a brief discussion, ED, Delhi assured GS, MEA that he will make all efforts to make uninterrupted availability of all required materials to provide and maintain the services.

15-03-13                                         Meeting with Dir (Fin)

GS along with Com R.K.Mudgal WP met Dir (Fin) and discussed the issue of abnormal delay in payment of GPF withdrawal , terminal benefits and non availability of funds for mtce. In  regard of delay in payments of GPF withdrawal, She told that the GPF contribution deducted from employees is transferred to the GPF trust and  disbursement of  GPF withdrawal payment is done on the recommendation of GPF trust.  We met to the concerned officer of the trust who informed that funds are released as per the requirement raised by units. Now we will have to find out the reasons of the delay payment of the GPF withdrawal. Area secretaries are required to take up the cases  and ensure that funds are utilised in proper heads. Regarding non availability of  funds for mtce, she mentioned the scarcity of funds and also told that efforts are being to  arrange the funds.

   
13-03-13 Times of India : MoC Sh. Kapil Sibbal Interview excerpts  :-

"Both BSNL and MTNL were not really making losses. How did they become loss-making? BSNL and MTNL paid Rs 28,000 crore for spectrum. They were forced to buy spectrum at that price. MTNL borrowed money from bank to pay to Government of India. They are now paying interest to bank and they are not getting enough income. So they are becoming sick. Same is the case with BSNL. 
    Now either the government bails them out because it can’t tell them that they are sick after taking Rs 28,000 crore and ask them to earn. At this point of time and in these market conditions, we do not want to allow any private equity into BSNL and MTNL. We cannot throw our silver in the market at a throwaway price. We will go to government and say some method must be found to compensate public sector companies for the money they paid for spectrum

  Meeting with CMD--GS, Com V.K.Tomar along with Jt Secy, Com R.S.Maan met CMD on 11-03-13 and discussed following issues-
  1. Child care leave- We demanded immediate implementation of child care leave in MTNL. CMD informed that MTNL has denied to implement CCL in a reply to parliament question. But after our insistence, he agreed to revisit the decision on CCL.
  2. Concessional Broad Band connection to MTNL/BSNL/DOT employees- CMD informed that case is under process and orders will be issued in this month only.
  3. Refund of BWA spectrum charges-- CMD told that case of refund of BWA spectrum charges was vigorously being pursued in DOT and informed that a cabinet note for refund of spectrum charge with interest will be sent to cabinet by the end of this month. 
  4. One increment on functional promotion to Sr Manager (DE/CAO) in same scale --GS explained the case in detailed and asked CMD to take decision on this issue as per provision of Gr B level  promotion policy in which it is clearly mentioned that one increment will be provided on regular promotion in the same scale. He assured to look into the matter.
  5. Shortage of funds for mtce of services: GS raised the issue of shortage of funds for mtce and explained how it is affecting the growth and mtce  of services which in turn is resulting in loss of revenue. CMD categorically mentioned there are no funds available in MTNL and efforts are being made to get funds through BWA spectrum charges and release of bonds through sovereign guarantee of govt for which govt has intended to give guarantee of Rs.3000 crore this year.
  6. Land monetisation-  CMD informed that there was positive approach of MOC&IT to raise funds through land monetisation in MTNL. Case is being explored as per his proposal.

Repatriation of Unabsorbed ITS officers to DOT and subsequent Deployment of relieved ITS officers in MTNL:

As per
<DOT order>  no. A-11013/64/2012-Abs. Cell (I), dated 11th March, 2013 and  <MTNL Corporate office letter>  no. MTNL/Co/Pers/Group A Absorption/2011/193  dated 11.03. 2013 all ITS Officers presently working on deemed deputation in MTNL who have not opted for absorption in MTNL are relieved and repatriated to DOT with effect from 11-03-13.

 

As per DOT order A-11013/64/2012-Abs cell(II-A) dated 11th March, 2013 and  <MTNL Corporate office letter> no. 400-45 / 2013-Pers. I (2) dated 11.03.2013 the ITS officers repatriated from MTNL to DoT through the above said repatriation order dated 11.03.2013 are  deployed in MTNL w.e.f. 11-03-2013 A/N as per < terms and conditions> of deployment of ITS officers in MTNL.  The List of ITS officers in MTNL is attached <list>


All the ITS officers repatriated to the Department of Telecommunications will be deemed to have joined DoT on repatriation before their deployment in MTNL. As such, these ITS officers are not required to physically report to the Department of Telecommunications on their repatriation.

After long persuasion of this Association, corporate office issues office orders to settle the pay anomaly cases where junior gets more pay than senior on account of implementation of pay revision w.e.f 01-01-2007. The pay of senior may be stepped up at par with junior and senior will draw his next increment with effect from the DNI of the junior subject to fulfilment of other conditions of pay anomaly as rule 22 of FRSR. <<corporate office order>>

   
10-03-13 CGO, WS division general body meeting--A beautifully organised GB meeting of CGO division of mobile services was held on 05-03-13 in IInd floor committee room, CGO building. About 100 officers of WS wing attended meeting which was addressed by GS, VP, CHQ, Shri Arun Passi, CS, Shri Sunil Kumar, CT, Shri Satyavir Singh, Jt CS Shri M.K.Singh. ACS Shri B.L.Singh & AS (WS) Shri Dilawar Ali. GS explained  about the financial health of the company and the efforts of the Association & management to get  it turned around. GS asked members to do their best to increase the revenue and assured that Association will do its best to get the pension issue and refund of BWA spectrum charges and other things settled to ensure the very revival and survival of the company. Members raised many queries related to the working of WS wing and also strongly voiced against the non availability of funds for the maintenance of services. GS assured to take up the issues strongly with the CMD & Dir (Fin)  & CGM (WS).

Shri V.K. Tomar, General Secretary, MEA, CHQ, alongwith Shri Parveen Passi, Vice President, MEA, CHQ, Shri DPS Chaudhary, AGS, MEA CHQ and Shri Raj Kumar, Jt. CS, Delhi Circle met Shri Pankaj Yadav, GM(F), Delhi Unit on 1/3/2013  and discussed various issues related to Accounts and Finance Wing of Delhi Unit.  The GS apprised the GM(F) regarding various vacancies in the cadre of AO,CAO and DGMs.  Issues regarding regular promotions in this cadre were also discussed.  It was stressed that guidelines issued by the Corporate Office  vide letter No. MTNL/CO/PERS/TFR POLICY/65/2002/169 dated 22/7/2008 should be followed scrupulously.

ITS REPATRIATION ISSUE

DOT filed a fresh application in Hon. High Court of Delhi last week praying before the Hon. High Court that DOT will comply with the direction of the Hon HC  to end deemed deputation of ITS by repatriating them from BSNL / MTNL to DOT. The application further prayed that DOT in compliance to the decision of the Union Cabinet may be permitted to send repatriated ITS  back to BSNL / MTNL on deputation for a period of 10 years in a diminishing manner.

This application of DOT came up for hearing today in the Hon. High Court of Delhi and the application was summarily dismissed. Hon. High Court directed DOT to respect the law of the land and comply with the direction of  Delhi High Court.

Some salient features contained in the Cabinet decision on absorption of ITS Group “A” in BSNL/MTNL:

a) Group “A” Absorption process in BSNL/MTNL stands concluded which in effect means that the seniority of the absorbed ITS is delinked from those who would, according to the note, continue on deputation for a fixed time frame.

b)  All the BSNL/MTNL posts have to be filled up by absorbed officers to the extent absorbed officers are available on priority basis.

c)  Govt fully empowers BSNL/MTNL to make recruitment to top Management posts which remain unfilled after promotion of eligible absorbed officers. This recruitment would be allowed under provisions of Rule 37which envisages that unabsorbed ITS would be also eligible to be recruited in BSNL/MTNL afresh after they get their pension and retirement benefits from Govt. for the service rendered by them in DOT.

d) BSNL/MTNL is allowed to retain the unabsorbed ITS officers on deputation (BSNL-941 and MTNL-83) for a maximum period of 10 years in a diminishing manner ie 10% will be repatriated/retired every year In MTNL, repatriation will be completed in 3 years time.

e) The deemed deputation period from 2005 also stands regularised

 Meeting with CMD on Pension issueMeeting on pension issue with CMD was held on 15-02-13 in CGO complex committee room. Dir (Fin), Dir Tech), GM (HR) & Jt GM (HR) were also present in the meeting. At the very out set CMD briefed  that  for last 12 years we all are trying to get payment of pension in MTNL from govt as in BSNL, but could not succeed. He further told that Today Company’s financial condition has come to an extent that we are finding it difficult to pay pension from our resources, so   MTNL management has recommended two proposals to the govt  (1)  Formation a single trust for executives & non executives with govt and contribution of govt liability of more than 4000 crore in the trust, and (2)  pension from govt as in BSNL after next pay revision when parity of scales of MTNL & BSNL can be done.  Association representatives expressed their concern over the viability of trust and surety of secured pension from this trust and maintained their unwavering position to get secured pension from govt as in BSNL because it is an issue which cannot be left on the mercy of management or govt, but to be secured through provisions in govt rules. Dir (Fin) endorsed the views of CMD as well as Associations/union representatives and explained that in present situation, MTNL cannot pay pension in the days to come so the formation of trust may be accepted as an interim arrangement till next pay commission. GS MEA and other representatives maintained their firm position to get secured pension from govt in any case. We also pointed out that the clause 20 of revised Rule 37 A which is said to be the govt guarantee is limited to the liability of govt to meet the short fall of the expenditure in case trust or PSU fails to meet it and that expenditure will be debited to the trust or PSU. There is no direct liability of govt to pay pension to the absorbed employees of MTNL. CMD agreed with the concern of the representatives and promised to take up this case with the govt to clarify the govt responsibility to pay pension to the MTNL absorbed employees in any eventuality of failure of trust. We were asked to provide the draft to be included in 37A to ensure govt liability of payment of pension.  We have maintained our position to demand and ensure secured pension from govt as in BSNL. Our efforts to achieve our aim will continue.If required, we can resort to trade union action to achieve our demand

1--Shortage of store items. Stress was given on acute shortage of drop wire. ED informed that about 400 Km drop wire is expected in next few days and purchase order for further requirement has been given. ED also stressed on the use of recovered drop wire.

2--Local promotion orders of the officers whose CRs were called for DE(LA) but left out after the promotion orders of 32 officers issued recently.

3-Local promotion orders in the cadre of Executive Engineer (civil)

4--Many other issues related to improvement of services and revenue generation were also discussed

3.       Pursue the employees who are not able to perform their duty properly to go for VR (voluntary retirement)

Association asks its members to pay special attention on the above points which are essentially required before  taking any further step to turn around the company.

 
   
12-02-13 Meeting with Member (services)----Com V.K.Tomar, GS, Com S.N.Prasad, CHQ President, Com R.K.Mudgal CHQ Wkg President & Com J.J.Mathias, CS Mumbai met Member (Services), DOT on 08-02-13 and had detailed discussion on pension issue. Association stressed on the secured and uninterrupted pension from govt and appealed him to take up the case with the concerned authorities in the Govt to get the secured pension for the employees/officers absorbed in MTNL as in BSNL. Member (services) also assured that he would make all his best efforts to ensure secured pension and family pension for the MTNL employees/officers. Our struggle to ensure secured pension from govt as in BSNL will continue.

He told that after getting the required information of floater pending cases of Delhi & Mumbai, all cases will be decided. Seniority cases were noted for further necessary action. Regarding DPC in different cadres, he told that corporate office is waiting the screening report from both the units and assured that all DPCs will be conducted at the earliest after getting reports from Delhi & Mumbai.

19-01-13 Mumbai CEC meeting--GS, Com V.K.Tomar, along with Wkg president, Com R.K.Mudgal, both AGSs from Delhi, Com D.P.S Chaudhary & Sanjai Kumar , CS Delhi Com Sunil kumar & CT Delhi Com Satyavir Singh and other CHQ office bearers from Mumbai attended the CEC meeting of Mumbai circle on 18-01-13. Com S.N.Prasad, CHQ President, presided over the meeting . CS Mumbai, Com J.J.Mathias welcomed the CHQ office bearers and raised the issues. GS apprised the house about the latest developments on various issues related to the revival of company, Pension & welfare of executives. GS made it clear that Association will fight and ensure secured pension from govt for which Association will discuss with all Unions/ Associations and  management to find the perfect solution. GS also apprised the house that due consideration is being given by the management on the issues raised by us through our resolutions passed in our CHQ conference. Regarding regular promotions in different executive cadres in all disciplines, it was apprised that sincere and fast efforts are being made by the management and the Association to conduct the DPCs at the earliest. Many queries were raised by members regarding seniority cases, CETTM cases, medical cases, Hindi translator, Civil ACP cases etc, which were replied by GS and assured to take up these issues with concerned officers in corporate office for early solution. Members raised the issues regarding un-viable projects like CDMA, overseas projects and FTTH project also. GS assured to take up the CDMA and overseas project viability issue with CMD, but regarding FTTH, members were asked to make all possible efforts to generate more and more revenue through FTTH which is very good technology and can be a life line for MTNL. CMD is very much concerned about FTTH, if there are any problems related to this project, let us know so that we can take up with the CMD.

  1. Rebate  on BB connections at the residence of MTNL/BSNL/DOT employees--Considering the long pending demand of Association, CMD agreed to give rebate on broad band connections at the residence of MTNL/BSNL/DOT employees.
  2. Filling all vacancies of Executive Engineer(civil) on regular promotion:  CMD was positive on this demand of Association and assured to take appropriate action.
  3. 0ld DPC with old bench marks and review of new benchmarks--after detailed discussion, CMD said that he would have a further discussion with other concerned officers in the corporate office before deciding any thing on this issue.
  4. Time bound functional promotion as assured in terms and conditions of absorption---CMD was not positive on time bound functional promotions but was very positive on the demand of Association to fill up all executives posts on regular basis and asked Association to come a concrete proposal. Association has also pleaded to review the promotion policy of executives to make smooth and faster promotions.
  5. Pension from govt as in BSNL--Association stressed to get pension from govt as in BSNL, however, CMD apprised that the formation of trust in DOT as per rule 37A is in process in DOT. Association asked CMD to pursue for pension from Govt instead of Trust.
  6. Issues like BWA refund, surrender of access 2G spectrum and other service related issues--CMD told that the suggestions given by Association through resolutions have  been circulated to the concerned wings for their views so that appropriate action can be taken.

Local officiating Promotion from SDE (T) to DE--Association brought to his knowledge that ACRs of about 50 officers have already been called for long back but orders have not been issued so far. ED assured to issue the promotion orders shortly.

Local officiating promotion from AO to CAO--ED informed that process to issue promotion orders in CAO cadre is on. Orders will be issued in a day or so.

Local officiating promotion from SDE (C) to EE (C)--Association asked ED to fill up the unfilled vacancies of EE (C) on local officiating basis. ED assured to discuss this issue with CE and decide.

Service matters related to shortage of store items, maintenance of FTTH connections, maintenance of copper cable, booking of faulty cables, monetisation of land etc were discussed in length.

Joint Forum leaders met Additional Secretary, DoT.

Leaders of the Joint Forum of BSNL and MTNL unions and Associations met the Additional Secretary, DoT and discussed issues connected with the viability of BSNL and MTNL, as well as important issues connected with the employees of BSNL and MTNL. It included immediate payment of Rs.1500 crore compensation to BSNL from USO fund, exemption of BSNL and MTNL from the one time payment for the additional 2G spectrum, enhancement of minimum pension from Rs.3500 to Rs.3880, settlement of pension anomaly, payment of Govt. pension to MTNL employees, etc.

COM.O.P.GUPTA PASSES AWAY: With profound grief, we learn that the Great Leader of the erstwhile P&T Trade Union Movement and former Secretary General of NFTE has passed away on 6th January. He was the inspiration and guiding light to most of the erstwhile P&T Unions and now the Telecom employees. He had clear foresight and successfully organised glorious struggles on various issues.
His demise is irreparable loss to the Telecom Sector Trade Union Movement. We pay homage and joins the entire Telecom fraternity as it mourns the demise of Com.O.P.Gupta.

Meeting with GM (HR) & Jt GM (HR) ----GS along with WP & CS met GM (HR) & Jt GM (HR) on 04-01-13 and discussed following issues.

1.       Regular DPC in different cadres of executives of all disciplines—They informed that process of regular DPC in all the cadres of executives of telecom, Finance, Civil & electrical has been started and assured to conduct the DPCs at the earliest after getting the screening & vig report from both the units. DPC of those JAOs whose screening report has been received in corporate office is scheduled to be held on 9th Jan,13. Screening reports for DPC to DE and CAO are still awaited from Delhi and Mumbai units.  Screening reports for promotion to SDE (T), DGM(Telecom/Fin/Civil/Elect) have been called for.

2.       Financial upgradation from the due date in cases where there is no vig case on the due date but DPC conducted on later date when there was a vig case—This issue was explained to GM (HR) and pleaded her to issue instructions to both the units to start the process of DPC for financial upgradation well before time so that DPC can be conducted on Due date, and also to give effect of financial upgradation from due date in cases where there was no case pending on that date but case erupted on later date before DPC was conducted. GM (HR) assured to take up this case and decide.

3.       Improved pay scale for JTOs (Civil) who absorbed with ACP—Case has been approved by finance, orders will be issued shortly.

4.       Preparation of updated seniority lists of different executive cadres—Jt GM (HR) agreed that it a case which needs to be decided at the earliest but he said that they required two SDE level officers from Delhi unit to be posted in corporate office to get these seniority lists and other seniority cases decided. He assured that CO will make arrangement to get required officers posted.

5.       Pending medical reimbursement cases in units because of shortage of funds in ED floaters—Jt GM (HR) informed that issue has been discussed at highest level in the management and assured that pending cases will be settled within 15 days.  

6.       RRs for promotion from AM (HR)/Mktg/Legal—GM (HR) informed that issue is still required to be discussed at higher level. Now issue will again be discussed with CMD.

7.       Relaxation in qualifying marks in E3 LICE—GM (HR) was informed that some candidates have represented that some topics in the exam were out of syllabus or under marked.  So, Association asked her to consider for the relaxation in qualifying marks from 40% to 30%. She said that she will get it examined and decision will  be taken on the merit of the case.

 tie up with IETE to impart industrial training to their students.
 Institute of Electronics and Telecom Engineers (IETE) is a leading
 professional institution under ministry of HRD. We have received the
 first list of students out of about 200 students from IETE who will
 undergo six weeks training at ITTM during Jan- Feb, 2013. ITTM hope to
 get more trainees from IETE and other institutes in the time to
 come. ITTM may generate some revenue through these processes.

Status on ITS repatriation case at Hon Delhi HC:

ASG submitted the minutes of the Committee of Secretaries final meeting held on 12-12-2012. ASG informed the bench that Cabinet is likely to take a final decision on this recommendation by the middle of January 2013.Hon.HC of Delhi extended the last date for implementation of its order to 01-02-2013. The matter is posted to 1st February 2013.

Representatives of BSNL & MTNL Unions/Associations met concern DOT officers and enquired about the ITS repatriation issue and the status of reply to be filed in the Hon Delhi High Court. It is understood that the third meeting of Committee of Secretaries headed by the Cabinet Secretary and comprising of Secy(T), Secy(Pers), Secy(Expenditure), Secy(Pension and Pensioners Welfare) and Secy(Legal Affairs) was held in the last week to clear the cabinet note on ITS absorption issue and the minutes of the meeting are expected to be issued today from Cabinet Secretary and thereafter the Committee recommendations will be sent to Cabinet for consideration. The reply Affidavit will be submitted to Hon'ble High Court Delhi on this line based on the minutes. DOT is going to pray that Group-'A' officers presently working on deemed deputation in BSNL/MTNL may be permitted to continue to work in these organisations on a temporary and diminishing basis for a maximum period of 10 years in which they would be able to build their own cadre of officers through the process of recruitment and promotions.

Director(Estt.) mentioned that regarding pension in MTNL, the matter is under consideration of DOT for formation of trust.

 Delegate session----Delegate session of CHQ conference was held on 14th & 15th December 2012 in New Delhi YMCA auditorium, Jai Singh road New Delhi. After flag hosting, delegate session was inaugurated by GM (HR) by lighting lamp. GM (HR), Jt GM (HR) & DGM (Pers) corporate office addressed the delegates and took the queries of delegates on various HR issues. GM (HR) & Jt GM (HR) assured the house that they will make all efforts to speed up the pending DPC cases in all executive cadres and attempt to hold Telecom, civil & electrical stream DPCs in the month of Jan,13. In next session, General Secretary placed his report before the house, which was passed by the house with one voice. Circle Secretaries of both the circles gave their brief report on the membership in Delhi and Mumbai and assured to increase the paid membership in the days to come. In second session, elaborate discussion was held on various HR issues including promotion policy, Recruitment rules, pension, and other HR issues.  On 15th Dec,13, after the approval of financial report, the detailed discussion was held on financial viability and survival of MTNL. Resolutions passed on HR issues and financial viability will be uploaded shortly.

Constitution amendments---Representative council approved the following amendments-

1.      New member enrolment fee—Rs 10/-

2.      Monthly contribution—Rs 40/- ( Rs 30 subscription + Rs 10 welfare contribution)

3.      Welfare claim----Rs 25000/- ( to the family of departed comrades)

4.      One CWC on every 100 paid members

5.      Circle President, circle secretary and circle treasurer will be ex-officio CWC member by virtue of their posts.

A grand open session was held on 13th December in Chinmaya Sewa Trust auditorium which was jam packed and overcrowded by the executives. Chief guest of the function was Shri A.K.Garg , CMD MTNL. Other guests, who addressed the gathering, were  Shri Pranjoy guha, Sr Telecom analyst & journalist, Ms Shalini Singh,Editor The HINDU & Sr Telecom analyst, Shri K.Ashok rao, National President, NCOA, Shri G.L.Jogi, President SNEA(I), Shri K.Sabestin, General Secretary, SNEA(I), Shri Virjesh Upadhyay, General Secretary, MTNL Mazdoor sangh (Recognised Union), Shri S.S.Nanda, General secretary, RTOWA. Shri B.K.Mittal ED, Delhi, Shri R.A.Gupta, PGM(O) Delhi, Shri Kamlesh Kumar, PGM(D) Delhi, Mrs Rajni Taneja, GM (HR) Corporate office, Shri D.N.Mishra,GM (A), Delhi Shri S.K.Arora GM (Mktg) WS also graced the occasion. CHQ President Shri S.N.Prasad welcomed the guests and General Secretary Shri V.K.Tomar delivered his keynote in which he highlighted the issues of pension from govt, refund of BWA spectrum charges, surrender of excess 2G spectrum, inadequate HR policies, pending HR issues like review of promotion policy/RR, framing RRs of DM (HR)/Mktg/legal/CS, regular promotion in DGM cadre, time bound functional promotion upto Jt GM, review of new bench marks, participation of MTNL in govt projects to earn revenue , single window concept in MTNL, adequate funds for maintenance. CMD in his address mentioned that he was making sincere efforts to revive the company, he said that MTNL revival proposal is with govt,he told that his main focus is to make the company loan free for which he is also making efforts to raise 7000 crore through bonds with govt guaranty , he said company can be revived with revival proposal but survival is possible only through our quality of services rendered to our esteemed customers. He called upon the one and all in MTNL to work to increase the revenue without which we cannot think of MTNL survival. He expressed his internal feelings to get the company turned around at any cost for which he sought the cooperation and support of all MTNL staff. At the end of open session,CHQ President Shri S.N.Prasad gave vote of thanks to the guests.

28-11-12 GS along with WP & CS met CMD and Dir (Fin) on 27-11-12 and expressed resentment and concern over the non-availability of funds in units for GPF withdrawal and payment of terminal benefits. CMD & Dir (Fin) assured to release funds from corporate office. Dir (Fin)  informed that GPF withdrawal has increased ten times in comparison to previous years. She also told that GPF withdrawal is more than GPF contribution in this year. These statistics indicate that all withdrawals are not genuine cases and they have been applied in panic. She asked GS to tell officers not to apply GPF withdrawal in panic.
   
28-11-12 GS along with WP & CS met GM (HR) on 27-11-12 and discussed following issues-

1. SDE to DE regular promotion--she assured that after receiving the screening & Vig report, DPC will be conducted immediately.

2.Regular promotion from AM(T)/JTO(T) to DM (T)/ SDE (T) against SCF quota---She assured that CRs will be called for in the month of December, 12 and efforts will be made to conduct the DPC in January ,13.

3.RRs for promotion from AM(HR)/Mktg/Legal/CS to DM---She said that now case is in advance stage and notification may be issued shortly.

4.E3 LICE---She said that after recieving the feed back from Delhi and Mumbai units, date will be notified. We have requested to decide exam date only after our  conference. She agreed.

   
26-11-12 Corporate office is going to conduct LICE for promotion from AM(T) to DM (T) some time in 2nd or 3rd week of December 2012.

Meeting with Dr. Mrs. Kruparani Killi, Hon MOSC&IT on ITS issue. Convenor/Jt Forum Com V A N Namboodiri and other JF leaders met Dr. Mrs. Kruparani Killi, Hon MOSC & IT at her residence on 24.11.2012 and held discussions on relieving of ITS from BSNL & MTNL. Among MOS’s, she is holding the charge of both PSUs. JF leaders explained in detail the issue and impact of non resolution of this issue on the viability of BSNL & MTNL. We explained that the Managements proposal to continue with the non-optee ITS on deputation for another 10 years is no way going to help the revival of BSNL or MTNL and in that case BSNL & MTNL will collapse within few years. So like the non-optees, other employees of BSNL & MTNL also should be taken back to Govt service for their job and pension security. Hon MOSC&IT had a patient hearing for about 20 minutes and assured that the issue will be further discussed with Hon MOC&IT, Shri. Kapil Sibbal. JF leaders submitted a memorandum also.

 

   
24-11-12 GS, MEA Shri V.K.Tomar  addressed the dharna organised by MTNL Mazdoor Sangh (Recognised Union) at Jantar Mantar on 23-11-12 on the issues of Pension from govt, refund of BWA spectrum charges, ITS repatriation etc. GS told gathering that these are the important issues for the survival of the company and MEA has also  been raising these issues for a long time. GS assured MEA's full support and hoped there will be joint struggle on these issues in the days to come.

HISTORICAL PARLIAMENT MARCH BY BSNL & MTNL EMPLOYEES ON 22ND NOVEMBER'2012: Thousands of BSNL & MTNL employees marched to Parliament today at 12:00 Hrs from BSNL Corporate Office, New Delhi demanding immediate relieving of non-optee ITS, continuing in BSNL & MTNL on deputation or to take all the BSNL & MTNL employees back to Govt Service.

Even after four chances to get absorbed in the PSUs BSNL & MTNL, the ITS officers numbering about 1,600 rejected BSNL&MTNL and opted to continue in government service whereas 4 lakh executives and non-executives got absorbed in BSNL & MTNL. Joint Forum representatives submitted memorandum  to hon'ble Prime Minister.

18-11-12 22nd November Rally to Parliament---United Forum of MTNL/BSNL Unions and Associations will take out a massive rally from BSNL Corporate Office, Janpath New Delhi to Parliament on 22nd November at 12 Noon to submit memorandum to Hon’ble Prime Minister demanding repatriation of Gr A officers who are on deputation in MTNL or take back all absorbed/recruited officers and employees back to DOT to end the discrimination and uncertainty of dual status of officers which is badly affecting the financial viability of both the companies. All officers and employees are appealed to attend this rally in full strength.

Delhi CEC meeting was held on 17-11-2012 in BSNL recreation club 5th floor Kidwai Bhawan.   More than 100 office bearers including CHQ/Circle office bearers/Area/Divisional Secretaries and CEC members attended the meeting. GS briefed the house about the preparation of CHQ conference in Delhi, and 22nd November rally to parliament house.

CHQ Conference---GS briefed the house about the importance of CHQ conference and Delhi Circle Conference which will be held with CHQ conference. He told that through open session and delegate session, we will discuss and convey our view point regarding revival /survival of MTNL and welfare of executives to the management and other concerned authorities.  This conference will bring lot of awareness in the officers and management in respect of working of the company and suggest many ways to come out of this dwindling condition of the company.   Venue and date of open session and delegate sessions will be as follows—

Open Session---13th December at Chinmaya Sewa Trust Auditorium, 79,Lodhi road, adjacent to Lodhi Garden, and in front of Mausam Bhawan. Open session will be followed by dinner at the same venue.

Delegate session---14th and 15th December 2012, at YMCA, Jai Singh Road, Near Jantar Mantar, behind Parliament Street Police Station, New Delhi.

Mumbai Delegates will stay in the YMCA tourist hostels in the same complex.

Keeping in view the increasing cost of the conference, CEC decided to increase the delegate fee from Rs 500/- to Rs 1000/- per delegate

It was also decided that All Area Secretaries/ Divisional Secretaries will have to submit the delegate list along with Delegate fee @ Rs1000/-, conference fee @ Rs.200/-per member and upto date subscription by 30th November. GS, Circle President, CHQ Wrg President, Circle Secretary appealed the office bearers to make the conference a grand success.

16-11-12 After long persuasion of this Association with ED Delhi, PGM(O) & GM (A), the process of officiating promotions in the cadre of SDE has started, and orders for local promotion orders from JTO to SDE are expected in a day or two.

All Area Secretaries and Divisional Secretaries have to ensure the delegate election and collection of up-to-date subscription/ conference fee @ Rs.200/- per member and delegate fee @ Rs.500 per delegate and submit to the Circle Treasurer at the earliest. 09-11-12 As per the Joint Forum of BSNL & MTNL Unions/Associations call, massive lunch hour demonstrations were held throughout the country on 08th Nov: 2012. At New Delhi more than 600 employees from BSNL & MTNL participated in the demonstration infront of BSNL Corporate Office.

ITS Repatriation Issue at Hon’ble HC

 

1.  ASG (representing UOI) made submission before the Delhi HC, that a proposal to repatriate unabsorbed ITS from BSNL/MTNL progressively within a time span of 10 years is under the consideration of Group of secretaries and that it will be very shortly sent to the Union Cabinet – Hon’ble HC  observed that   Bench is not concerned with what cabinet is to decide and that the 10 year time period is absurd".

 

2.   Counsel for the respondents (ITS) submitted that they have to be formally relieved from BSNL/MTNL immediately ending “deemed deputation” and thereafter they can be taken back to BSNL/MTNL on “deputation” which is legal.-  Hon’ble HC observed this is nothing but continuance of the present situation.

      This will putting an end to the immediate possibility of their entry through back door deputation.

 

3. Finally Hon’ble HC Bench directed Counsel for UOI, BSNL/MTNL to relieve all unabsorbed ITS by 15th Dec failing which UOI should submit a detailed proposal. The case is posted for 18th Dec:’12.

 Captioned matter was listed on 01-11-12 for Final hearing as Item 24 in Court No. 1 before the Principal Bench comprising Hon'ble Justice Syed Rafat Alam and Dr. Justice R.C. Panda.
Mr. Rajshekhar Rao appeared on behalf of the MEA. Counsel for the Respondents stated that the Senior Advocate engaged in the matter was not in Delhi and requested the matter to be heard on another date.
